The picture---Kyle railroad leaves a DARK railroad tank car parked across a DARK old Highway 40 at night which is DARK. Nights have been proven to be dark for a long time now.

Any 12 year old would know better than to leave a dark railroad tank car across a dark Highway when it is dark but did Kyle railroad figure this out?.

Kyle railroads negligience KILLS Pearl Smith which KYLE railroad proves they were negligient when they paid $275,000 for her death. This $275,000 sure wasn't paid out of the goodness of Kyle railroads heart. If you or I had parked a dark rail car across one of the railroad executives driveways and they were killed going 70 mph when they hit it we would be in jail for negligient homicide. These in the railroads pockets FRA people have been STUDYING rail car reflectorization since 1952. The railroad is like we would have to have step ladders and shop towels to stick on reflector tape. But noooo. KDOT turns around and is going to put $150,000 gates (THAT WE PAY FOR) at this 1 train a day with a 25 mph train speed limit which the railroad will make a small fortune in overcharges off the project---10 grand shipping and handling to get the equipment there---10 grand for the design with consists of going to a file cabinet and pulling out the schematic of one of the 10,000 crossings just like it.

Does all that this crossing need is bright street lights or KYLE railroad to pay a couple people to flag the crossing once a day?
Have Kyle trains been hit more than once at night at unlit crossings.

Did Kyle railroad report this collision as being at a "private" crossing to the FRA ...The rail equipment was reported to have been t raveling at ? Mph with 4 locomotive(s) and 36 cars(s). The CAR had been traveling in a westernly direction at 070 M ph. The railroad was operating on main line track over a private road crossing...Well certainly they did! Do private crossings qualify for Federal or state safety funds? Nope Would these gates do more good where there are 40 or 50 trains a day and the train speed limits are 50/60/70/80 mph? SOLOMON--Floyd Danner has spent a lot of money and a lot of tears waiting for a signalization to be installed at a railroad crossing on old Highway 40 west of Solomon.

Danner, 615 S.W. Third St., recently found out that the state has agreed to place signals at the crossing where his granddaughter, Pearl Smith, was killed three years ago.

"I can't begin to tell you how I feel about this," he said.

Smith, who was 18 at the time of the accident, was killed when the car she was driving impacted a stopped tanker car at midnight.

Only crossbucks mark the site.

Stan Whitley, information specialist with the Kansas Department of Transportation, said reflective crossbucks, flashing lights and gates will be installed between October of 2003 and 2004, at a cost of $150,000.

Whitley said only that the crossing had been bumped up because of a review of a formula used to rate crossings for signalization. The review bumped the crossing into the top 20 percent of dangerous crossings.

A site visit by representatives of the Kansas Department of Transportation, Kyle Railroad and Saline County was on June 11.

The Union Pacific line is leased by Kyle Railroad, based in Phillipsburg.

Danner said that Kyle representatives have talked about removing the eastern most crossing at the site because it is not used. A Kyle representative could not be reached for comment about that issue.

Danner said that after his granddaughter was killed he and Smith's father, Chris Smith, began a petition to have the crossing signaled. Danner said 700 people signed their names, but that the petition was never presented to Kyle.

The family received a $275,000 settlement a year after the fatality. At the time of the settlement, Danner wondered why the railroad couldn't have used that money to upgrade the crossing before the fatality occurred.

Many rural, lightly used crossing are gettting gates. Why? Because if they fail the chances of being killed are a lot less. Costs the RRs big bucks if it's proven the gates failed. They would rather kill more people on the main tracks protected by crossbucks and pay the 1/2 million or whatever because the government pretty much has it fixed where they can KILL AT WILL.

All these little short slow trains need are a couple spot lights shineing backwards and half decent sight lines. I know, have like glow in the dark Ed siloutettes with the 8 inch thingy stuck on the forehead under a spot light. And Ed---You can't be a beacon if your light don't shine!

The "challenge" of "not for cowards" annoyed me, and I think anyone who'd put up the detailed personal info I've seen some throw up is foolhardy.

Thanks to the new forums I know what all the fuss is about. Much
ado about nothing. NO one stopped to look or listen in any of the reports.
So now it's the railroads fault ? Lets see, that falls under the category
of Personal Responsibility for one's actions, words,choices or decisions.
It's easier to blame someone or something else than to take responsibility
for ones actions today. Railroads don't want to kill anyone, employee or
citizen.
Their job is to move goods as safe and efficiently as possible
not to lose money . No train crew wants to injure or kill anyone either. Time
