I'm a bit puzzled really - I suspect we hear about every single railfan who gets hassled, but how many get hassled as a percentage of the total number of railfans out there? It's the same as those car reliability surveys - according to those I should be spending every waking hour at the garage getting mine fixed, but it's not missed a beat in the 6 years we've owned it and regularly outdrags stuff that's 9 years younger. Likewise I've not had any problem railfanning - then again I do pick locations carefully (getting out into the wilderness can have benefits, as in no people = no problem!)

What i REALLY REALLY don't understand is why, when, and how it became a given that only "bad guys" would be upset about loosing their freedoms. The counter argument made by the obediant sheep among the flock stating "if you haven't done anything wrong, you shouldn't have anything to worry about"...is NUTZ!! because it makes the blind assumption that our leaders would never intentionally abuse their powers.. When haven't they?

I think it is because an oversized portion of out population has grown up brainwashed to be obediant little children, to do as they are ordered to. But, I doubt that will happen without first having them give away so much of their freesdom that there will be a revolution necessary to take them back.

Of course it isn't neccessary for me to stand up for America, since I'm Australian, but I will stand up for the US National Anthem. I was taught to do this at school on Coral Sea Day every year when we remember the 1942 sea battle, even though I wasn't around for that war.

But I always thought the great thing about being a railfan was that you could go out and photgraph trains from public property, from roadsides and bridges without upsetting anybody. Sometimes railway employees (or even passers-by) get upset even when you are doing something quite legal that doesn't affect them. In that case I normally move elsewhere, since I don't see why I should share in something that is their problem. Besides, it is more fun to watch somebody getting upset than to participate.

But Dan, I'm not quite sure what it is that you are proposing to vapourise these locomotives. The "sabot" rounds I'm familiar with are the sub-calibre projectiles used in our "Phalanx" close in weapons systems. We are only allowed to use tungsten projectiles rather than depleted uranium (although I understand Australia has about half the world's supply of non-depleted uranium so it isn't clear why!). The sabot (from the French word for "shoe") is also the source of the word "sabotage" from putting a shoe in the works. I think of this when I contemplate an FFG flight deck covered with these strange bright orange plastic banana peels after a CIWS firing. I should explain for those who don't need to worry about this that the "sabot" is a plastic cover over the CIWS projectile designed to "peel off" into four sections on firing, allowing the smaller, heavy "dart" to travel further and faster and hopefully find an incoming missile and upset it (along with a couple of hundred others)

This could make your average SD70ACe look quite a bit like a colander and fairly static after going through the engine and control equipment, but would hardly vapourise it unless you fired quite a lot of rounds.

I know the term is also used for anti tank rounds which have an armour piercing capability, and these would possibly have a more striking effect, but for vapourising, I would have thought that a five inch gun HE projectile with contact fuzing would be a simpler and cheaper option in the vapourising category.

Saw an interesting locomotive the other day at my neighborhood yard. It was a leased unit, orange in color. I could have chased across the yard and snapped happy snaps to my hearts content, but instead I went to the trainmaster's office, rang the door bell, and explained what I wanted to do. The NS employee said no way, no how, forget it, no pictures. If I wanted pictures, I could go up on a local viaduct and shoot away. Was I disappointed? Yes. Did it make me mad? Did the employee hate his job? I don't know. Did he hate me? Probably not. So why was he so adamant? Might be explained in one word- safety. He didn't want me run over and I can understand why he felt that way. Was he polite? Yes. Tyrannical? No.

Until I gain majority interest in Norfolk Southern railroad, it's their property and their rules. If the same guy asked me to give him a ride in my patrol car, he would have to sign a bunch of liability release forms before I ever said yes. Will I be polite? Yes. Tyrannical? No.

But there is one problem. Even though you where Railfanning on Public property and a Railroad cop pulls up and tells you that takeing Photographs of Trains is wrong what do you do? The cop is wrong. The RR cop could be right too. If you don't know if you are in the right or in the wrong call the Police to make sure that you are doing the right thing so that just incase a RR cop does pull up you have proof from a real officer that you are ok. That's what I would do. I as a Railfan am not that brite at time nor am I stupid. But I know what is right from wrong. When anyone of us go Railfanning we MUST use our God given head. There are alot on this forum have said time and time again that after 9/11 things took a major turn. Plain put.....If I have a problem with someonw when I am out Railfanning,I will take my Cellphone to call the Police just to make sure that I am lajit. That is what the Police are there for. Well the way I see it just because the road has an easement to CROSS the tracks that doesn't give you the right to loiter there. My company has easements all over (Cable TV) and I can go anywhere we have an easement to work on the cable when need be but that does not give me the right to hang out on someone elses land just cause we have an easement.

A railroad cop's status really depends on the state they are operating in. In Arizona, for example, I believe that peace officers not only must be sworn, but ALEOAC certified (which means they went through an academy.) ALEOAC certification gives a peace officer the right to enforce the law anywhere in the state of Arizona... except for the Indian reservations. In effect, this means a BNSF cop can make an arrest on "public property" if he sees a violation of state law occurring. It's different in Alabama; there is no question that an NS or CSX police officer can make arrests on railroad property, but they must have juristictional agreements with local counties or municipalities to do law enforcement off railroad property. (As a certified deputy, I recently had to be "resworn" to do traffic control and security for an Auburn football game- my law enforcement authority was limited to that county juristiction for a very limited time.)

To add misery to heartache, there is provision for private citizens to make arrests. Private citizens are also not bound by constitutional guarantees concerning evidence. This is how store employees (known as "loss prevention agents") tackle shoplifters leaving a store; it's also how bounty hunters get to kick down doors and enter houses without a search warrant. And this was in effect before 9/11...

It is always easy to blame the government for stopping you from doing fooli***hings. It's not so easy to realize that the Constitution regulates the actions of your government... not your fellow citizens.

Being a railroader for 29 years, I have seen both sides of the coin.

The rail fan/foamer that wants to just take a photo, while being on public property, not inhibiting traffic or being a hazard....are usually left alone.

However, there are some who feel it is their right to get "up close" or put themselves in a location that could be unsafe for them or the railroad employee.

I think a prerequisite for every rail fan should be to memorize and always follow the first rule in almost every single railroad's rule book....IE...Safety is the first importance in the discharge of duty.

I think the manufacturer you reference only uses two "N's," dating all the way back to the orginal camera "Kwanon." As I understand it, a Sabot round would be the right thing to use with a cannon, and Walmart should have Sabots on sale about this time of year. But since we're way off topic anyway, why has the military gone to smooth bore guns and Sabot rounds as opposed to just rifling the barrels?
