I never stated I could do whatever I wanted...where did I say that? And I put the spike back..and contacted the company about it. They stated they would have it looked at. Hey...maybe just maybe I did a good thing. Call it vandalism if you want.

 Back in 2002 I contact a railroad about a malfunctioning level crossing light...the light would flash..then turn off..and THEN the trian would roll though..I observed this for a couple of weeks thinking that someone employed at the railroad would show some interest in getting this fixed. I finally contacted the road and they had it repaired. And I got a $1000.00 gift coupon out of it...yes..some railfans have a bad name..but a thousand bucks says I don't.

I call it trespassing.

 

Let's look at another perspective.  Our bosses out here are required to follow proper safety rules when on the property.  Were you wearing proper safety apparel?  Sturdy work boots?  Safety glasses? long pants?  no articles of adornment?  If not you are creating a safety hazard out here.  Did you have proper rulebooks on you?

Managers aren't allowed on our tracks without proper safety gear.  So if you are part owner, you should respect that.  And I bet you'd be the first one to sue if a dragging chain cut off your leg...

I' m a smart guy..I stay away from dragging chains.. I'm always well clear of the tracks..well back.

Big Brother is watching...but he can't do much aparently..look at all the graffiti out there. Where are the authorities. And I'm not talking about causing problems or destroying property. I'm just one man standing well clear of the line.

Don't get mad...I really don't condone trespassing on railway property...just wanted a bit of an argument...

 This post is so very much like so many  others...a women trespasses and then the next fifty responses are yeah yeah she's an idiot..

Mr. Ulrich,

I talked to a lawyer buddy, and he said [or close to it anyway], "While owning stock in a company does give you some benefits not afforded to the general public. It doesn't give you the right to go on the property any time you wish without permission. You are still trespassing. It does make it easier to get permission."

I didn't ask him for details [and nor will I] because if you get him started on law or marathon running, you have to hear bout it for an hour plus and I'll pass.

Own very small holdings in all the Class 1s but don't tresspass and when I call in some malfunction I give name, railfan, cell number and the malfunction and any other pertinent data excpt one time got excited when low boy hung up on crossing and could hear train in distance.

Arguing is fun..not illegal behavior..but relax..we're talking about walking along a railroad right of way... not rape or mass murder. I agree it is illegal and I apologize profusely for offending anyone. You gonna be okay?

Besides...how much public taxpayer money is invested in railroads? And CSX (as well as others) are asking for more to improve infrastructure. If the taxpayer is putting money into the business then the taxpayer has a right to walk along its right of way (within reason)...just my opinion.  If you're going to take a hard line with me just for being on your property then don't take my money.

CSX and all the other private railroads pay taxes to all the communities in which they own property and deserve to have their property protected just like any other tax payer. 

If all the tax payers in your city have the right to walk through your house any time they want, your opinion has validity.

You may be trolling or are actually speaking legitimately.  If I can share a personal experience regarding "Trespassing without bad intentions".

About a decade back, I had to pick up my wife's car from a repair shop after work..  The shop was about a one and quarter mile walk.  I decided to take a shortcut and do a  3/4 mile long walk along a CSX branchline on the railroad's right of way. The next grade crossing was at least 1/2 mile distant.   Along the way I walked into grass clumps growing through the ballast and the right-of-way, which to my dismay were loaded with thorns and sand spurs.  Since I was wearing shorts, my legs were scraped up vividly.   As I continued towards the grade crossing, I was forced to walk around a metal box along the way and stepped up onto the track ballast to do so.   OOPS!  Soft spot in the ballast and I twisted my left ankle.  Hobbling on, with wasps flying around me,  I got onto the sidewalk as soon as I came upon the grade crossing and went to pick up the car.  I was eating humble pie, especially considering that I was in pretty good physical shape. 

Lesson learned: Even though I was a railfan, was confident and felt I was being careful..................................................It wasn't worth it! 

You, me and others here may be careful, but that doesn't and shouldn't amount to a hill of beans to railroad officials.

I posted some time ago that my initial posts were intentionally overstated. I do not condone trespassing on railroad property. I just wanted to add some flavor to a "let's beat up that idiot" post about some lady who got a ticket for trespassing. I've trespassed, but I don't make a habit of it.

I did pull a spike once and reported the problem to the railroad. They were grateful and sent a team out to look at it. They did not lecture me on trespassing.

 I know trespassing is wrong...I know trespassing is wrong...I know trespassing is wrong..I know trespassing is wrong...I know trespassing is wrong.. I get it!!!!

I don't care if you are the biggest shareholder in the company.   You ask permission before you step on the property, AND, you abide by all applicable safety rules, and wear the proper P.P.E.   And you had better have proper authorization papers.

We don't have a problem with those who deface cars out here.   If caught, they face the same thing you would if caught.
