Trespassers 'outraged' at getting tickets

Who would want to bet if this idiot would stub her toe as she trespassed. Would want to SUE for not being protected.

Just like the durnk that got electricuted after climbinbg on top of the train and touching the high wire.  

 

September 12, 2008 CHARLOTTESVILLE, Va. - People caught trespassing on CSX property here are lashing out at police for issuing them tickets, according to a story in Charlottesville's The Hook newspaper.

"We're paying that officer," said Marya Dunlap-Brown, who was slapped with a ticket Aug. 13 after she trespassed on railroad property. "Get a criminal," she said. "Catch someone dealing drugs."

According to Operation Lifesaver, 486 pedestrians died last year after being hit by trains. But Dunlap-Brown said police shouldn't patrol the tracks for trespassers. "And if the railroad is worried about safety," she said, "the railroad should put their own officer down there."

The police department's effort to crack down on trespassing has netted numerous tickets. On Aug. 28, 58 alleged trespassers made the court list.

Issuing tickets doesn't work...look at the graffiti murals that must take hours to paint...

Besides...how much public taxpayer money is invested in railroads? And CSX (as well as others) are asking for more to improve infrastructure. If the taxpayer is putting money into the business then the taxpayer has a right to walk along its right of way (within reason)...just my opinion.  If you're going to take a hard line with me just for being on your property then don't take my money.

A point was raised that I am a firm beliver of.

I a person wants to jump off the top of a building. Why should some else say , "NO" and spend tax payers money to stop.

If a person over doses on drugs. Why should we have to pay for the services to save.

If a person gets hit by a train. Then they should pay for my time lose waiting for the clean up and their removal.

Why don't you give this a test with a stroll down the northbound lane of I-5? I assume before you go out and do this you will amend your will to instruct your estate not to sue the people driving the truck that hits you.

Kind of what I was thinking.  Just try strolling though an Amtrak yard, and see where the "I have a right, its my taxdollars here" argument gets you.

This is no different than motorists who are PO'ed for getting a speeding ticket and blame the officer for wasting tax payers dollars and should be out chasing crack dealers instead of giving them a ticket for going 75mph in a school zone...

...all a part of our fabulous "no-responsibility" society.

Let's mirror the logic fully:

I pay for the military with my tax dollars, so I should be able to walk into a weapons lock-up or hop into a tank, after I drive rightfully unchallenged through the front gate of the complex or base, and have myself a good time...heck, I even paid for the gas I'll use!

Or, let's see....okay, how about this...:

I pay for schools, so I should be able to walk into any elementary school building and not expect to be approached by interested staff wondering if I have business there.

That didn't work for you...I'll try one more:

I pay my dentist's salary, or a portion thereof, so I should be able to enter his business premises if I have to wait for a bus on a cold day.  His office is just near to the bus stop, and it would be soooo much more convenient for me to wait inside.  He better not ask me to pay for the key I'll need.

Nah - at least the foamers are there because of the tracks.

She's mad because the tracks are between her and where she wants to go and she's too lazy to use an established crossing to do so.

If you want to really hear a lot of wailing from there, put up a substantial fence with barbed wire on the top and make 'em use an established crossing...

Guaran-dang-tee ya they'll complain because they scaled one fence and couldn't get back out when a train came through....

Too late!  A nut job did that here in San Diego a few years ago.  Lots of damage until he threw a track on a freeway and got hung up on a New Jersey center barrier.  Local cops shot him when he wouldn't come out.  End of story.

If trespassers around here, they stand chance of getting shot; virtually all of my neighbors are bearing arms LOL.

In Ontario on Route 400 Toronto-Barrie the speed is 100 kM (60 mph)      So many accidents with fatalities from speeders & impared drivers that the police now have two caesnas flying overhead, especially during busy summer periods and holidays     One motorcyclist was caught doing 140 mph & when interviewed on tv along with others, complained that there should be signs posted when the route IS aircraft patrolled & complained of entrapment.       He didn't mention that there are signs & markers on the highway

Recognize that in Virginia the Officer is required to issue a summons for most misdemeanors.  A physical arrest will not be made unless the Officer can articulate reasons why he believes the person will not appear in court.  The person refusing to sign the summons would be an example of a good reason.  The penalty for trespassing includes the possibility of jail time, but a summons must be issued.   What often happens if someone doesn't appear as promised by signing the summons is that the prosecutor will waive the possibility of jail time which then allows the case to be tried in the person's absence (they gave up their right to represent themselves and are not in peril of jail).  The subsequent fine, if not paid, can be assessed to the person's Income Tax refund or interfere with their ability to renew their Operator's License..  They have some pretty good ways of collecting.

The argument of "look at the graffitti" seems to be based on the argument that since someone has committed the crime, that it should not be enforced.  There are unsolved murders in the world, but that doesn't mean we stop enforcing those laws. 

The right to own property is fundamental to American governance.  It is one of the reasons that we fought that Revolution thing against the King.  If someone is employed by the government (via taxes paid by someone), would they then have no expectation of privacy on their property?  If someone has cashed a government check in any form or received any sort of benefit from the government (with pecuniary value), is their property then wide open to everyone who has ever paid taxes?   The property owner (CSX in this case) certainly has the right to post their property against trespassers, and we (collectively, through our elected representatives) have set forth law to permit such enforcement.

But..I freely walk along railroad tracks where I own stock in the railroad that owns the track. I own stock..I own a piece of the pie and I reserve the right to walk along it while of course exercsing proper precautions so that I don't get in the way of work or cause injury to myself.

You may own your house...you are free to stick your head in the furnance...but would you do it? There's where WITHIN REASON comes in again.  

If I own something (or part of something) either through stocks or through involuntary confiscation of my money (taxes) then I will feel free to act like an owner. Otherwise they just take your money and you bend over like a ninny.  This, incidently, is why the economy is in such a mess today. We have stock holders who treat their investments like a gamble..and they have no interest at all in even reading the annual reports. More of these OWNERS should get out to inspect their properties..The other day I pulled a spike on a mainline..I see busted ties...that's a concern to me...(and it should be a concern to the folks who run the trains as well). I report that stuff at teh annual meetings... I care. And I can care becuase I check things out first hand and do not rely on accounting ratios to tell me everything.

If you want me off your property then don't make me an owner and don't take my money to run it.

I don't agree that it is reasonable to assume you can walk on private property with impunity.  You may be a stock owner, but you are neither an employee nor on the executive of the corporation.  You have put up money in an enterprise that presumably offers some utility to you in terms of earning power.  Yet, your valuation doesn't include your courtesy and respect of the entity's policies, nor the laws which govern both of you, and certainly not the employees of the corporation you favour.  I sense some egoistic thinking behind it. 

I would still be interested to know why it is perfectly "reasonable" for you to trespass in one instance and not the other...railroad right of way or yard vs. military establishment.  Your sole criterion in either case is a contribution of money...at least, that is what I understand so far.

So now not only does our frend Mr. Ulrich believe he can trespass on RR property, he is now vandalizing it.  (pulling a spike is vandalizing, IMO).  Why not go down to the local RR yard and walk right up to the diesel shop?  Or heck, climb aboard an engine.  You are part owner. Sign - Dots [#dots]   Owning stock does not grant you the right to do whatever you want. 
 

Then you can go to your local military base and walk around.  It's ok you pay taxes, so you have a right to be there.  Heck, walk up to the NSA building and give yourself the grand tour.

It's a question of degree... we're talking about walking along a line..and you're right..I'm not an employee or an executive..I'm an owner. And ownership confers rights..specifically the right to inspect own's property to a degree that is reasonable and does not endanger others. (WALKING along the line). most roads don't have a problem with people walking along most lines...look at all the graffiti out their.. some rails laugh about it and even enjoy it..

 There's nothing egtistical about my position..again...we're talking about WALKING along the right of way...I learn alot more by doing that than by reading annual reports.

 My investment does offer utility to both myself and the entity that has received the money. It is important to both of us.. My retirement hangs on it and the railroad gets my money.
