Finally got a much needed rain last night. Nice gentle soaker for a few hours. Can't remember the last rain we had like it. It's been really dry here this year.
Work on a couple roundhouse tracks. Judging by the font and large numbers on the rear of the tenders, I'm guessing AT&SF.

This is 100% correct.
All photographs are immediately and automatically copyrighted by the photographer. There are actually two enforceable rights created the moment the shutter is clicked.
One is actual ownership of the photograph. The other is the right to reproduce the photograph.
All my pictures I post say "-Photograph by Kevin Parson", and I do not have to state they are copyrighted... they are.

I would think that photos posted from Google search Images are considered to be public property in the sense that they are already on the WorldWideWeb for everybody in the world to see. If you simply call up a search and BAAM, the pic is there, its already been shared probably hundreds or thousands of times. Most pics found this way are not copyrighted and I would assume carry an implied consent to share.
If we lift a pic from a site that requires an account log in or access to some sort of private company hosting service, then there is no implied consent to share it.
Again, the entire point of copyrighting is to properly funnel monies to the creator of the artistic product should it ever be used for profit. 99% of photo sharing on the web is not for that purpose.
Many copyrighted photos actually have wording across the bottom that identifies the artist and or the website that "hosts" the photo. So when its copied and pasted the proper information comes along with the photo. The photos that do not have this feature are likely not copyrighted to begin with.

I would have to believe the sharing of the vast majority of non-personally taken pictures here would be considered for nonprofit educational purposes (leans toward fair use being acceptable), fact based work (leans toward fair use being acceptable), and the reproduction does not reduce the value of the original work (leans toward fair use being acceptable. Not sure how full or partial reproduction comes into play, or even how it is applied. Part of a photo? All of a photo? All of a photo collection?
To an admitted layman like me, it sure seems like the fair use exception would apply here, with some exceptions possible.

I believe the intent of the copyright laws as it pertains to photgraph sharing has to with reselling for profit...as is the main concern that underpins most copyright laws.
So if you take a photo off of the internet that the artist charges nothing to look at, but you make money off of it somehow, and worse, claim its yours, then the artist has a case.
And while it may be technically illegal to share photos without permission, any reasonable judge would want to know the level of damages suffered by the artist because the photo he already placed on the internet was shared by somebody else posting it on the internet also, but just on a different site. The answer usually being no damage done.
Since I'm not a professional photographer, musician or artist, just a professional retiree, I was very proud to see a photo of mine reproduced in a thread here after I'd posted in in in Weekend Photo Fun. It caused me no pain or hardship. Go ahead, as far as my photos are concerned.

I yield to your knowledge! What I wrote was from way back when I was in business (Over 30 years ago) and that was for music (Sound recordings and had nothing to do with online reproduction) not photos. Always best to follow the most conservative advise on these things. I only post photos here that I took or know are OK to use.

Pretty much how it is done. When I was in the Recording Business and producing tapes and CD's of School Concerts, I would meticulously (CYA) send checks for the total amount from the recordings I made (actually just a few cents per copy per song). Things changed at one point and I got a Bill for several hundred more $$$ from the company that handes those things (which will remain nameless here). The bill totaled more that I took in selling the CDs and Tapes! I called the legal dept. of the company and cried a bit. The gent asked me how many copies I was making and I told him about 75. He started to laugh and said what that would amount to given the number of CDs/tapes I was making would cost them more to file all the paperwork for it than they would make. Now if I was making ten thousand copies, they want their share!!!
He said if you are making less than (enter large # here) they don't want to know about it and they are not going to come after my little business for it either. He did tell me that they do want the phrase "© (year) Owner/publisher name" under the Title. He said that would let other teachers know what company published the music score.
From then on I did that and didn't worry about it. I did usually give a donation roughly equivalent to what I would have spent to the County Music Teachers Assn. as a thank you for hiring me to record the concert.
The Baltimore Sun employed a great photographer, Aubrey Bodine, who documented Baltimore and Maryland in the 50's and 60's. His legacy website still sells his photos. Every week someone is posting his pics on the Old Baltimore Photos group on Facebook. They are never taken down by administration.
If you have 100 photos you want to share, you would be better off creating an album on one of the free photo sites and giving us a link.
Sunny, warm and not too humid in the Shenandoah Valley. My wife's sister and niece are coming in 2 days, except the sister has canceled 5 times before. We get along, but she lives with her daughter and her grandkids are always getting sick. I expect something will come up the last minute.
The niece's choice in men leave something to be desired. Ear rings that dilate the earlobe are not my thing in men or women.

I have a few questions for those with more knowledge than me...
I recently acquired a large box of railroad books, magazines, decals, ect. In among the books there were about 100 or so pictures.
Most have notes about who took the photos, where they were located, and dates.
I would like to share these with the group, but I don't want to run afoul of any copyright issues. Can I post them here?
Most pictures are of ATSF work equipment, but there are pictures of all kinds of stuff.
All dated between 1962 - 1973.
A few go back to 1951.

A huge undertaking was the rebuild of the PRR GG1 that took a ride into the basement baggage room of Washington union station.

Hope that'll get the ole adrenaline going. I finally got the three brake lines on my Accurail box car installed. I've seen some of the work you guys turn out. Really good. Mine, not so much,...yet. I know it takes practice. So, we'll keep trying.

What a whirlwind of a weekend. Started off by going to see the new Indiana Jones movie Thursday night. I know some people on here have already stated they didn't care for it, but I for one loved it. Yes there were a couple scenes where the computer generated graphics were poorly done, but overall I appreciated what the show did which was allow me to escape reality for a couple hours while reconnecting with an old favorite in a fun storyline. I like the fact they did not try to make him do too many things he shouldn't be able to anymore. They let him age gracefully and paid homage to the earlier movies throughout.
Then my daughter and I went to look at a car for her on Friday. Complete disaster. Not only was the car not exactly as advertised, but when we arrived, three large dogs immediately circled my truck barking non-stop, the people didn't come out and corral them for 3-4 minutes, and one of the dogs propped his front paws up on my drivers door to get a better look at me as he barked and proceeded to slide his claws down my door scratching it up. Twice! Spent quite some time that afternoon buffing the scratches out. While others may not, I can still see them if I look for them.
Then, like a shinning light later that evening, a coworker of my wife contacted us saying she knew of someone selling a car right in my daughter's price range that lived only a few blocks away from us. Stopped by and looked at it Saturday morning and while it has a couple scrapes and a couple spots of rust on it (it's a 2008 so what do you expect?), inside the car looked brand new. Runs like a top. Clearly well cared for. The couple have been looking to sell the car, but didn't want it going to just anybody so they hadn't been advertising it. She picks it up tonight.
Finally got down for some time on the layout yesterday. First day in a long time. I tore open a couple locomotives I bought recently to see what they need for decoders and speakers and got them ordered. Two of them are old LL Proto Erie Builts that a seller on Ebay had mistakenly listed as EMD F3's. I've been wanting one for a while now and just happened to see them as I wasn't actively looking for more F3's. Guess it pays to look a little beyond what you are looking for sometimes.

Hi TF, I thought you were saying that she was in a car crash. I'm glad that wasn't the case. My niece Vicki has had that happen to her twice. It is a hard thing to go through but ultimately it is probably for the better that it has happened relatively early in her life. Have hope. Your daughter is still young enough to find the right person. I know that you will give her a lot of support and that you will be patient while she sorts things out. If she is anything like my niece she will be pretty angry for a while and she may seem hostile to you at times. In reality she will just be asking for your understanding. Cheers!! Dave

Thanks for your support Dave. I guess it was a poor choice of wording on my part describing the situation but that's how it was yesterday seeing her that devastated.
She already has a problem with depression and under medication for it, and this is a bit much for her to take. We're all plenty worried about her. My younger daughter is picking her up today and comming over to see if we can sort things out. Its gonna be a tough day.
