Betsy Ross should have trademarked her red and white stripes with a blue field. Then UP would have to pay a royalty on every emblem they used with her design.

Well, it's your MRR, but I don't see how this would help anything, regardless of your feelings.

Reminds me of when some people threw away their Beatle records after John's remark (or I guess the Dixie Chicks CDs, for a more modern example).

Bet they all bought them back later ......

After reading about the lawsuit, I'm going down to the layout and throwing out what few pieces of u.p. rolling stock I have. What a joke! Why don't they worry about moving the dead trains.

Are those who give up and/or boycott UP models (which will hurt the makers far more than UP) going to also boycott AMTRAK and now CSX , too ???

Like it or not, it's UP's legal option (in fact, the legal system has effectively told UP to use it or lose it - they can't NOT charge without losing their trademarks!), as it was AMTRAKs before them (via the Wathers, Kato, etc licences) and now CSX.

Brace for the other RRs to do the same thing.

In fact, I'm waiting on MAYTAG to start charging for the ROCK ISLAND (yes, they own it !!!).

As I have all the UP (one loco, some boxcars and a caboose) that I need, that would impact me FAR more than any UP fee. But I would pay it without any problems, as it is Maytag's right, too.

Meanwhile, I think ATHEARN is in a lot of legal trouble.

Union Pacific and CSX are the RR's i most model NS and BNSF are second.Yes i am loyal to the UP.

Jonathon, this is actually about the trademark, which is a little different from copyright. See the little TM next to the logo you are using. Oh, sorry Elliot, I wrote the wrong thing. I ment trademarking. It is different than copyrighting, I know. Yeah, ALL the UP logos have the TM next to them now. Sheesh!

Not loyal to any of them at all and especially the Union Pacific! I don't give a Rat's ___ if they have the right to collect moneys for the use of their logo, colors, etc., etc. This whole situation is assinine and even if they arn't embarrased over their actions, I am embarrased by it!

I am not really big on the U.P. I have a few engines and cars, I like the paint. I wouldn't go out of my way to get one, unless I liked the way it looks.

I have a couple of UP cars (a stock car and a reefer) but just about everything else in my collection is Southern Pacific, Western Pacific and Sacramento Northern. Even though all are now fallen flags, they are considered to be "Union Pacific property."

It's STUPID.

And yeah, yeah, I know, it's the law.

But the law in question is STUPID.

Athearn charging extra for UP models but refusing to pay the fee is stupid too--all that means is that there are TWO stupid organizations butting heads--but UP has a lot more money and power. The fact that one stupid organization sues another stupid organization does not mean that they are not stupid.

I wouldn't even give a damn about the whole farce if they didn't insist that SN, SP, WP etcetera, must be licensed as well.

I'm not loyal to any railroad corperation. I would be happy if UP went bankrupt and died.
I own a few UP freight cars cause I like the paint schemes and the FEF-3 because its design is beautiful.

Yes. I'd hate to see the loss of any model train products because of licensing issues. If [scale model] manufacturers dropped production of one, whose to say that there wouldn't be additional cuts in the future over the smallest infraction? Imagine: no more Santa Fe models because of a row with BNSF? Tragic, just tragic.

I have one stock car and three reefers. Since I am into eastern roads, UP doesn't really fit except for some interchange cars. Otherwise I am neutral on them. I think licensing fallen flag trademarks is not in keeping with the spirit of trademark laws whether or not it is legal. Lionel btw makes one part with the Ives name just to keep the trademark active. If UP was to paint some cars in the fallen flag colors and logos then I would be comfortable with that also.

Besides US railroads taking over Mexican railroads I don't think any railroad that exists today will buy anything else (exept for CN).

I certainly don't go out of my way to acquire UP items. I was raised in Southern Illinois so my favorites are still the Illinois Central, Missouri Pacific, Chicago and Eastern Illinois, Nickel Plate, Louisville and Nashville, and other midwestern roads.
