How loyal to the Union Pacific are you?
Posted by Big_Boy_4005 on Thursday, June 3, 2004 3:25 PM
Athearn and Lionel have said no to UP licensing fees.

If no more model trains were made with Union Pacific markings, would you care?

This isn't intended to be more discussion of the lawsuit! This is for you to tell everyone how much impact the Union Pacific has on your modeling and buying habits.

Personally, I own a couple of engines and a bunch of cars, but I don't go out of my way to buy UP. I would be perfectly happy to buy undecs and paint them myself, which makes what UP is trying to license somewhat meaningless.

Sorry Lupo. [:(][;)]

I think the terms "loyal" and "Interest" are two different things.

I have no reason to be "loyal" to any railroad, but I am interested in a couple (as it relates to a hobby).

Who's Union Pacific? I ight have some UP stuff (mostly in a scrapyard I'll have[}:)]) but for the most part it will be all northeast. Until Athearn releases a UP flag SD70M WITH FLARES I'm not getting any UP engines (then again that new Kato AC4400 looks nice)

Would I mind if no one made UP models? Nope; I've got the few I need. Unfortunately, I need more C&NW, C&EI, C&A and Mo Pac stuff. I'd REALLY like to see a model of 1385 one of these days (BLI, are you listening?), and we'll never get one if this whole licensing garbage isn't satisfied soon (and politely).

Thankfully, the NKP logos are public domain!

I would willingly give my life fighting for the right of UP to license their logo.

Right... [(-D][(-D][(-D][(-D][(-D][(-D][(-D][(-D]

Actually I see them as just another railroad... not necessarily any better or any worse than any other railroad.

If all production of UP models stopped today I have most available UP engines I want, because today arrived the latest addition: I got my Lionel Veranda and a P2K FA / FB set, now my roster for UP till 1960 is almost complete, 39 units : 25 diesels, 14 steam.
as I read all this things about modeling UP, I feel almost [:I] ashamed, collecting UP locomotives, so the least I could do not to offend fellow forum members is censor my signature . .

If they stopped making models with UP markings......It wouldn't affect me in the slightest. I have only a couple of UP items as it is and maybe a few of the fallen flags. And they are what I refer to as rolling scenery. That is not to say that I dislike UP, but I wouldn't say I like them either. They have a few interesting pieces of history that I might like to own someday....for example the FEF3 4-8-4 ....but I happen to like it because it's a neat looking locomotive, not because UP ran it.

I say make all models undecorated......let's bring back painting and decalling....

In the meantime, I'll talk with the CEO of Maritime....I may get him to ease up on the licensing contract thing.

Be careful what you wish for. ......

As far as 90% of the country's railroads..three words ...Sherman Anti-trust Act. You may be old enough to remember Ma Bell..maybe not.

I'm extremely loyal to UP. I don't really approve of this copyrighting stuff, but hey, they've been around for over a century, so let them do what they will. If they stopped producing UP models, I'd die, or model ATSF.

Jonathon, this is actually about the trademark, which is a little different from copyright. See the little TM next to the logo you are using. Technically you shouldn't be using that, but everyone here knows that you don't REPRESENT the railroad, you just LIKE it a lot. If you were selling something you could get into trouble. Of course that is what all the comotion is about, because after all these years UP has suddenly decided to enforce their rights over it's use.

Thanks everyone, you are proving my point perfectly. Keep the responses coming.

I certainly don't go out of my way to acquire UP items. I was raised in Southern Illinois so my favorites are still the Illinois Central, Missouri Pacific, Chicago and Eastern Illinois, Nickel Plate, Louisville and Nashville, and other midwestern roads.

Besides US railroads taking over Mexican railroads I don't think any railroad that exists today will buy anything else (exept for CN).

I have one stock car and three reefers. Since I am into eastern roads, UP doesn't really fit except for some interchange cars. Otherwise I am neutral on them. I think licensing fallen flag trademarks is not in keeping with the spirit of trademark laws whether or not it is legal. Lionel btw makes one part with the Ives name just to keep the trademark active. If UP was to paint some cars in the fallen flag colors and logos then I would be comfortable with that also.
Enjoy

http://www.pioneerlocal.com/cgi-bin/ppo-story/localnews/current/ba/06-03-04-307130.html , so, what's all your paranoia about the fact your using a product un- regulated by and unauthorized by the very entity that carved a life out of this great land. Here, in a moment of hesitation, a corporate, is to pay out the *** for just what a part of the environment has incurred opon the rights of way, and so needed it is, to compensate for punitive damages, which will never be repaid. Sony finances a video, played on MTV, "Big Locomotive," 1989, which depicts a UP DD40X in a high speed collision on a basement model railroad. Get It? A BASEMENT MODEL RAILROAD! Shows the world how.... Then Areosmith, bless their hearts, produced "Living on the Edge." ....and so. What would you do? The law can't touch this, the only legal rercouse is to do formally what is being done. And, at the expense of higher pricing (also called the cost of doing business), remember, these companies, howerver cherished, however loved, are actually, flagrantly breaking the very copyright laws they would use to sue your very *** off with. So use the bandwidth for something constructive. Save a life, or something. Many threads are under-way to suggest Uncle Pete should just kick the bucket! Enjoy Getting Over It!acj.

Yes. I'd hate to see the loss of any model train products because of licensing issues. If [scale model] manufacturers dropped production of one, whose to say that there wouldn't be additional cuts in the future over the smallest infraction? Imagine: no more Santa Fe models because of a row with BNSF? Tragic, just tragic.

I think a large number of us already lament the demise of prototypical railroads due to mergers, etc. in the real world. We shouldn't have to bare the loss of their scale model counterparts, too. That would be a real let down for the hobby.[:(]

I'm not loyal to any railroad corperation. I would be happy if UP went bankrupt and died.
I own a few UP freight cars cause I like the paint schemes and the FEF-3 because its design is beautiful.

I have a couple of UP cars (a stock car and a reefer) but just about everything else in my collection is Southern Pacific, Western Pacific and Sacramento Northern. Even though all are now fallen flags, they are considered to be "Union Pacific property."

It's STUPID.

And yeah, yeah, I know, it's the law.

But the law in question is STUPID.

Athearn charging extra for UP models but refusing to pay the fee is stupid too--all that means is that there are TWO stupid organizations butting heads--but UP has a lot more money and power. The fact that one stupid organization sues another stupid organization does not mean that they are not stupid.

I wouldn't even give a damn about the whole farce if they didn't insist that SN, SP, WP etcetera, must be licensed as well.

Not loyal to any of them at all and especially the Union Pacific! I don't give a Rat's ___ if they have the right to collect moneys for the use of their logo, colors, etc., etc. This whole situation is assinine and even if they arn't embarrased over their actions, I am embarrased by it!

Oh, sorry Elliot, I wrote the wrong thing. I ment trademarking. It is different than copyrighting, I know. Yeah, ALL the UP logos have the TM next to them now. Sheesh!
