Definitely a gate. One of the things they have to fix is replacing the gates that were knocked flat in the accident. It was a tractor trailer dump truck. The train tore the trailer off the tractor, which was still drivable after the accident. The fact that the tractor and trailer separated on impact probably saved the truck driver.
AMTRAK locomotive so most likely had a working camera. BTW signaled or unsignaled crossing?
Maybe it is time for separate hefty fines and suspensions levied both against drivers and the company that does not train and instruct them correctly. If I was a company and knew that maybe part of my operation could be shut down for not training my drivers correctly I would make sure the drivers are trained that it is an immediate job loss of any violation whether or not the driver ran into the train. By showing that all drivers attended such a course a company's suspension would be just probation.
Is it possible that as a passenger or crew member I can sue the driver/company for reckless endangerment even though no injury took place??
I don't know why North Carolina truck drivers have so much difficulty understanding the rules at railroad crossings.
