From the other postings it is clear that the U.S. Department of Justice Southern District of Texas under the leadership of Michael Shelby United STates Attorney is perparing to go to trail.

Lets look at a few items related to the case.
1) 2 UTU members that were both campaign managers for 2 UTU presidents have reached a plea Bargin.
They have stated or in the case of one (lied and then confessed and stated) that the President Current and Past was taking so called pay offs.

2)Former Designated Legal Counsels made payments.
3)Other UTU members took and gave money (laundry) both for gain and some unaware of themselfs being used for passing the money.
4)Former and current Designated Legal Counsel have been given a "deal" to tell the truth. After the next serious of trails it is believed that the Lawyer reveiw boards will have records and can and should revoke their license to pratice.
5)the U.S. Department of Justice is currently only interested in Crimes going back for approximately 6 years. It is believed that the practice has been occurfing for years .
6)There has been a report of coverups.
7)There has been reports of destruction of evidence.

So, can the UTU under new leadership ever get clean to what the memberships would like?

What do you think?

Here is a union that needs a purging and a Federal Trusteeship like the one the Teamsters have had for several years to root out the corruption and keep it out. Also, the Congress needs to take a good hard look at the FELA system and some alternatives. The way the system is set up this sort of thing was bound to happen. The question is, does this sort of thing go on with other unions that have members subject to FELA (BLE, BRS, BMWE, Machinists and Electricians)?? Also, the Jones Act (governing merchant marine among others) may also have these issues. Something needs to be done to protect the injured employee without opening the door to this sort of abuse.

UTU is a union?
When did this happen?
All this time, I thought it was a insurance underwriter and a lawyers scouting service!

Sorry LC, I don't agree. The problem in not with FELA, but with corrupt union officials and lawyers. Any time there's a honey pot around, the smelly bears will be lurking about. If FELA is eliminated, the railroader will be chained to Workman's Comp. I know people with honest claims who've been screwed into the ground. WC is corrupt, but with a corrupt WC, the employee screwed. The RR's have been wanting to kill FELA for generations. Congress can chase after the corrupt union types, but leave FELA alone. Whenever someone says, "Something needs to be done...", it gives me the chills, babe.

As an outsider looking in, I believe that professionalism at the top can be achieved if the union membership takes a real interest in making it so. Corruption comes when too much temptation is floating around and not enough people are really watching. The membership has to take more of an interest in their union than the dues withheld from their paycheck and grousing among themselves about what wasn't included in the latest contract.

Skeets-

I hear what you are saying about Comp, but having been through the FELA system I can tell you it NEEDS to be fixed somehow. Perhaps going to Comp is not the right way.

Mookie-

FELA = Federal Employer's Liability Act.

The utu is set up so that once elected they can not lose the office. every time someone votes the vote only tells the local chairmen what the members want they will vote ( politically) on what they feel is in the best intrest for the mass. it may not be what the members want hence the same guys stay in. Now the kicker if the national is caught ( like they are now) you cant vote them out. in the ble if someone brings up a vote to kick someone out its counted and let the cards fall where they may. if they say your out your out.

and your defenitly dont want fela gone this will open the door to 18 hr days 1 man crew remotes on the maiin. why ? cause the railroad will no longer be responsible for what happens the rule books we have will be thrown away they wont care if you go between a train moving at 60 mph to make a cut. in most cases they will want this as it will save time then. and if you get hurt they wont care who steps up to do your job.

The just of the matter is get rid of the utu and have a real union represent the conductors.
