I tried jumping in front of a bus, but in my city you don't have to be at a bus stop for them to pick up riders. So the danged drivers keep stopping expecting me to board.

So, I'm gonna try trains next, big heavy ones.. Just let those suckers try and stop in time, I DARE them....[8]

This is starting to remind me of the Religous Fanatics (can't spell today) thread we had a while back.

Dan, Ed, I'm still waiting on that address for the cement truck driver. When I get that to him, he'll make up a special batch just for the occasion. The Don has already been paid for his troubles.[swg][}:)]

As I understand it, a Sabot round would be the right thing to use with a cannon, and Walmart should have Sabots on sale about this time of year. But since we're way off topic anyway, why has the military gone to smooth bore guns and Sabot rounds as opposed to just rifling the barrels?

You shoot a cannon at railroads, Chad? Isn't that a bit drastic, even for the CN Borg? I think the manufacturer you reference only uses two "N's," dating all the way back to the orginal camera "Kwanon." Still, when I put the 500mm f4.5 on my Canon, some folks consider it a cannon (some even reference it as "the mountain howitzer."[8D]

[#ditto][#ditto][#ditto][#ditto][#ditto][#ditto]waltersrails. You must be talking about "You Pee" since I dont have any trouble with the railroads that my friends and I railfan. It also helps if you go to the same spot for awhile. I go to the same spots and the crews know who I am, what I am doing, and they don't have a problem with it. If you want to complain about it thats fine just don't do it here.

I hope this topic gets shut down.

Being a railroader for 29 years, I have seen both sides of the coin.

The rail fan/foamer that wants to just take a photo, while being on public property, not inhibiting traffic or being a hazard....are usually left alone.

However, there are some who feel it is their right to get "up close" or put themselves in a location that could be unsafe for them or the railroad employee.

I think a prerequisite for every rail fan should be to memorize and always follow the first rule in almost every single railroad's rule book....IE...Safety is the first importance in the discharge of duty.

You can say till your blue in the face, but that dosent necessarly make it true.
Cities and counties have, for decades, encroaced on RR property in the construction of "public" roads...even if the taxpayers paid for it dosnt make it taxpayer property.
If your foolish enough to use taxpayers money to build a swiming pool in my back yard, then, regardless of who paid for it, its my pool!

PS, we need an address for the driver of the concrete truck.

I say the unpaved SLANTED edges of public roadways were paid for by taxpayers, and as such are NOT railroad liability properties. "They may be a sworn officer, real police is a very loose term, but they work for a private company not a government entity. Their power off the railroad property in my state is limited except for investigative power of a crime that was commited on railroad property (i.e. they cannot make a traffic stop on a public street and issue a traffic citation with possibly the exception of a grade crossing violation which usually is on railroad property). Of the cases where I have knowledge the special agents always had the local police with them when they made an arrest off railroad property. The jurisdiction of the railroad police is generally the railroad property."

A railroad cop's status really depends on the state they are operating in. In Arizona, for example, I believe that peace officers not only must be sworn, but ALEOAC certified (which means they went through an academy.) ALEOAC certification gives a peace officer the right to enforce the law anywhere in the state of Arizona... except for the Indian reservations. In effect, this means a BNSF cop can make an arrest on "public property" if he sees a violation of state law occurring. It's different in Alabama; there is no question that an NS or CSX police officer can make arrests on railroad property, but they must have juristictional agreements with local counties or municipalities to do law enforcement off railroad property. (As a certified deputy, I recently had to be "resworn" to do traffic control and security for an Auburn football game- my law enforcement authority was limited to that county juristiction for a very limited time.)

To add misery to heartache, there is provision for private citizens to make arrests. Private citizens are also not bound by constitutional guarantees concerning evidence. This is how store employees (known as "loss prevention agents") tackle shoplifters leaving a store; it's also how bounty hunters get to kick down doors and enter houses without a search warrant. And this was in effect before 9/11...

It is always easy to blame the government for stopping you from doing fooli***hings. It's not so easy to realize that the Constitution regulates the actions of your government... not your fellow citizens.

Be nice to each other and pass the popcorn.

O.K, you may be correct to a degree, but isn't this the exception rather than the norm??????? I'm 42 years old, railfanned a lot in my younger years and had only one "negative" experience with a yard master (who was just doing his job).

QUOTE: ........... also hate their jobs, hate their employer, and hate ANYONE that interrupts their chowing down on a doughnut, drinking coffee, smoking, and behaves outside their sphere of understanding, which is pathetically tiny.[V]
- Hmmm. I don't know guy, but in many cases a railfan's attitude and demeanor has a significant bearing on how he will be treated by railroad employees. It seems like the majority of the time a railfan that stays cool headed and shows good manners fares out O.K when challenged by employees or police.

QUOTE: Well, this is a fight that cannot be won, gang, unless there is a 100% united front that will let the major carriers know that they need to have us on their side[^] NOT fighting them.
- We have to face reality here. Class 1 and Regional railroads are Busineses trying to make a profit, reduce expenses, and avoid lawsuits. Excet for trespassing, we don't play a major part in their plans. That's the cold reality. Most of us are aware of this and are not bothered by it. Unless (I hope it doesn't happen) terrorists start blowing up or derailing trains left and right, the rail industry is not going to pay us much attention. Doesn't seem to bother most railfans. Don't forget that over the past two decades, a few railfans that chose to criminally trespass or harass railroaders have made it harder for the rest of us that use good sense when near railroad property.

QUOTE: [V] A way to protest: write your member of the house and your senators and tell them that you want to have Amtrak de-funded, and have the railroads restore ALL pre-Amtrak trains, at 100% of all costs on their own! Then we'll see...
- Amigo...think realistically........that will NEVER happen. Amtrak was created because the railroads wanted to dump passenger service. Except for Southern, passenger trains were impacting profits significantly by the late 1960s after the mails were transferred to airplanes (courtesy of Lyndon Johnson and his allies in the air industry)

If Amtrak were defunded.......so what for the railroads. Top managers would likely celebrate quietly! One of their biggest liability weights would be gone. A significant number of senators support the freight railroads and are not going to vote for sandbagging the railroads with the ENORMOUS liability involved with taking over passenger service again.

Not happening........unless it's on a model railroad.

Stay cool, use common sense and courtesy when challenged. Don't start shouting "It's my constitutional right, yada, yada, yada......... The 1970s and 80s are gone. We're in a tougher, much less friendlier world now. What you've been complaining about is simply a reaction of regular human beings to this colder world where people are often rude and nice guys get sued.

One of my favorite quotes dealing with life came from Clint Eastwood in the movie "Heartbreak Ridge". It was: " ANALYZE, ADAPT, and OVERCOME!" This actually works. You over come with good common sense and thinking.

Peace.

Well the way I see it just because the road has an easement to CROSS the tracks that doesn't give you the right to loiter there. My company has easements all over (Cable TV) and I can go anywhere we have an easement to work on the cable when need be but that does not give me the right to hang out on someone elses land just cause we have an easement.

But there is one problem. Even though you where Railfanning on Public property and a Railroad cop pulls up and tells you that takeing Photographs of Trains is wrong what do you do? The cop is wrong. The RR cop could be right too. If you don't know if you are in the right or in the wrong call the Police to make sure that you are doing the right thing so that just incase a RR cop does pull up you have proof from a real officer that you are ok. That's what I would do. I as a Railfan am not that brite at time nor am I stupid. But I know what is right from wrong. When anyone of us go Railfanning we MUST use our God given head. There are alot on this forum have said time and time again that after 9/11 things took a major turn. Plain put.....If I have a problem with someonw when I am out Railfanning,I will take my Cellphone to call the Police just to make sure that I am lajit. That is what the Police are there for. And one more thing. Like others have said,GET PERMITTION FIRST befor you tresspass! Allan.

Saw an interesting locomotive the other day at my neighborhood yard. It was a leased unit, orange in color. I could have chased across the yard and snapped happy snaps to my hearts content, but instead I went to the trainmaster's office, rang the door bell, and explained what I wanted to do. The NS employee said no way, no how, forget it, no pictures. If I wanted pictures, I could go up on a local viaduct and shoot away. Was I disappointed? Yes. Did it make me mad? No. Were my "rights" impeded? No.

Did the employee hate his job? I don't know. Did he hate me? Probably not. So why was he so adamant? Might be explained in one word- safety. He didn't want me run over and I can understand why he felt that way. Was he polite? Yes. Tyrannical? No.

Until I gain majority interest in Norfolk Southern railroad, it's their property and their rules. If the same guy asked me to give him a ride in my patrol car, he would have to sign a bunch of liability release forms before I ever said yes. Will I be polite? Yes. Tyrannical? No.

Heavy butter on the popcorn, please. And make my co-cola fully leaded... it's gonna be a long night.

Chief, take a memo for me.....to the Chairman, Joint Chief of Staff.....effective immediately...withdraw all US forces from Iraq, Afghanistan, Korea, Japan and Europe. Make plans to conduct operations up to and including open warfare on the railroad companies of the United States. Report status of forces and recommended courses of action NLT 01 Nov.

We shall vaporize their un-patrotic US flag decal bearing locomotives with the plasma of our depleted uranium SABO rounds, whilst we take pictures from the edge of their property wearing un-licenced UP logo T-shirts and hats........that'll show them.....

Okay KP...done....anymore requests....

Dan

large Diet Coke and some Jordan Almonds for me Vic

Of course it isn't neccessary for me to stand up for America, since I'm Australian, but I will stand up for the US National Anthem. I was taught to do this at school on Coral Sea Day every year when we remember the 1942 sea battle, even though I wasn't around for that war.

But I always thought the great thing about being a railfan was that you could go out and photgraph trains from public property, from roadsides and bridges without upsetting anybody. Sometimes railway employees (or even passers-by) get upset even when you are doing something quite legal that doesn't affect them. In that case I normally move elsewhere, since I don't see why I should share in something that is their problem. Besides, it is more fun to watch somebody getting upset than to participate.

But Dan, I'm not quite sure what it is that you are proposing to vapourise these locomotives. The "sabot" rounds I'm familiar with are the sub-calibre projectiles used in our "Phalanx" close in weapons systems. We are only allowed to use tungsten projectiles rather than depleted uranium (although I understand Australia has about half the world's supply of non-depleted uranium so it isn't clear why!). The sabot (from the French word for "shoe") is also the source of the word "sabotage" from putting a shoe in the works. I think of this when I contemplate an FFG flight deck covered with these strange bright orange plastic banana peels after a CIWS firing. I should explain for those who don't need to worry about this that the "sabot" is a plastic cover over the CIWS projectile designed to "peel off" into four sections on firing, allowing the smaller, heavy "dart" to travel further and faster and hopefully find an incoming missile and upset it (along with a couple of hundred others)

This could make your average SD70ACe look quite a bit like a colander and fairly static after going through the engine and control equipment, but would hardly vapourise it unless you fired quite a lot of rounds.

I know the term is also used for anti tank rounds which have an armour piercing capability, and these would possibly have a more striking effect, but for vapourising, I would have thought that a five inch gun HE projectile with contact fuzing would be a simpler and cheaper option in the vapourising category.

M636C

Peter,

The misspelling was intentional, to be taken in context with another recent pointless thread. Fortunately, I've never had to rely on CIWS as being the final act of defense (or defiance [:D]), and certainly hope I don't have to either. Given the situation I'd much rather the engagement was terminated by a Standard well before then.

You raise an interesting issue.

Sure, it is easier to "get ahead" within the system by supporting those in power. I'm sure they will always have a use for dedicated psychophants.. So long as the psychophants enjoy the look of theor own shoelaces, "everybody is happy"...right? [}:)].....

But at some point any rational being has to stop and ask themselves if yielding even more control to those claiming power, simply to please THEM, is in the best interest of freedom.

my take on that is that freedom is a precious commodity. Once you give it up, the price to get it back is always way higher.

What i REALLY REALLY don't understand is why, when, and how it became a given that only "bad guys" would be upset about loosing their freedoms. The counter argument made by the obediant sheep among the flock stating "if you haven't done anything wrong, you shouldn't have anything to worry about"...is NUTZ!! because it makes the blind assumption that our leaders would never intentionally abuse their powers.. When haven't they?

I think it is because an oversized portion of out population has grown up brainwashed to be obediant little children, to do as they are ordered to. And I really wi***hey would just grow TFU! and take control of their lives instead of depending upon the ideologue of their choice to do their thinking for them.

But, I doubt that will happen without first having them give away so much of their freesdom that there will be a revolution necessary to take them back.

now a days it seems as though most folks are too busy being liberal or conservative "fan boys" parroting the thought and speak of their party lines,.. to just stop for a moment and think things through for themselves for a change.

Well man, you are right, it is gonna take some one with guts to be willing to stand up for their constitutionally guaranteed freedoms.

But, I don't think the railroads are the villain. Our own gov't is a much bigger thug.

All this "surrender your freedoms so that it will be easier to protect you" bs, is exactly that.....BS. Yet the majority of the population are such scared little wimps, they just bend over and take it, excusing it away with such nonsense as "B'aaaa, if you're not doing anything wrong, then you should have nothing to worry about,...B'aaaa" and the sort.

Already there is gathering an abundance of information indicating that the authorities granted under the patriot act are being abused by the FBI

http://www.cnn.com/2005/LAW/10/25/2fbi.surveillance/

And still the sheep among us just follow blindly and say B'aaaaa! while munching their free popcorn furnished by "the man"...

Sometimes it amazes me just how gullible people are willing to be in exchange for a pat on the head and an "atta boy" from their "superiors"

I think K.P. is right. He should boycott the railroads. Don't watch any more trains. Don't take any more pictures. That'll show 'em. The railroads will be begging for his mercy before he knows it.

Hey Harrier, put a sock in it you bone head! Rosa Parks wasn't standing up for the Bus Foamers.......Sheesh. I think that all foamers should band together and bring the RRs to their knees by implementing the grand foamer poobah's plan which entails........um...uh...well....uh....they'll figure that out later, but they will bring the RRs to their knees dammit. My suggestion is that the millitant foamers out there protest by lining up on the tracks to stop all operations. I promise that I'll stop....Really I will........

I'm a bit puzzled really - I suspect we hear about every single railfan who gets hassled, but how many get hassled as a percentage of the total number of railfans out there? It's the same as those car reliability surveys - according to those I should be spending every waking hour at the garage getting mine fixed, but it's not missed a beat in the 6 years we've owned it and regularly outdrags stuff that's 9 years younger. Likewise I've not had any problem railfanning - then again I do pick locations carefully (getting out into the wilderness can have benefits, as in no people = no problem!)

QUOTE: Originally posted by K. P. Harrier

Railroads are lying, abusive tyrants toward railfans. It has been proven time and time again that those that standup in unison to injustice are rewarded. Look at the famous Rosa Parks (who just died) and the Civil Rights movement! Railroads need to forcefully learn what American justice is, and not be trampling underfoot the American flag.

I say expose railroads to the world … And railroad stockholders will soon get the point, and force the needed reforms. I beg: Who has the guts to standup for America?

Where's Ed when we need him? He's one of the top troll detectors on these forums. In the meantime, I'll sit back with some pretzels and a cold beer to enjoy the show.

I'm not sure I've ever been lied to, or been abused by these theoretical "tyrants." I must be railfanning in all the wrong places again. Dagnabit...I miss all the fun. Vsmith, as long as you took the time to set up the machine, I'll grab some popcorn!

It really does take a creative mind to compare the civil rights movement with the ........um.....a.....*abused railfan movement*..... Good luck!

Who?
Maybe we should do a protest, get them to let us do legal things. This is not an issue as big as racism, but it should be delt with....eventually.

It's their property, they (RR's) can do what they want on it (within reason and federal laws). As long as you respect the property line, so should they.

Would you like someone you don't know looking over the fence into your backyard or worse, your bedroom, all the time and have this same person claim it's THEIR RIGHT to see what you are doing in the privacy of your property (home). I didn't hink so.
