This is called the Right of Publicity. News use, fine art, and personal use are all protected by the First Amendment.</p> <p>Note that this is separate from the Right of Privacy. Publicity is for publishing the photo, Privacy is for actually taking the photo. You have no reasonable expectation of privacy on the front porch of a locomotive, but you do in your bedroom with your blinds are closed.</p>
