This is a sort of a problem where I live.
In Victorvile and Hesperia, the tracks, the 15 freeway and the Mojave River split the entire area in three.
Thing about the tracks is that people live on both sides of them and in some parts, BNSF Police forces have been vigorously writing up people for even standing 30 feet away from them. They've also managed to catch a couple of people who use the tracks as shortcut, as opposed to wasting time by walking a ten mile trip to the Main Street bridge down the street, just to get to their friends or job across the tracks.
My personal solution, if someone's stupid enough to get hit by a train, then let their stupid @$$ get hit. And then find a way to block an idiotic lawsuit by some lawyer trying to make an easy buck.
Make them work for their millions.

This is unfortunately part of the problem. One area is safety for the railroad people, and another is safety for nonrailroad people. Then we have the financial issue of the courts handing out HUGH somes of money and awarding stupidity. They may be a Darwin Award winner, but their family is taking that cash straight to the bank. Now think about it. The railroads may paid the lawsuite. But in the long run, that cost is passed along to the buyer of the goods the railroad hauls. Now, who buys those goods? Do you shop at Wal Mart? Do you go grocery shopping? Do you buy from Best Buy? How about that new Ford, Chevy, or Honda, did you buy any new cars or trucks lately? Many of the things we all purchase are shipped by trains. We, the public, end up paying for other's stupidity and theft by paying more for what we buy.

Sooo, you are saying that it is wrong if someone cares about what could happen to someone if, God forbid, a train came through, and the hunter was hunted? Well, I disagree a 110% with those 2 statements.
Here is an example: You are the hunter on the WSOR's Right of Way, and suddenly a train comes barreling down the tracks and hits you. You will probably wish someone would have talked to the railroad about putting signs up to warn people, if you even survived. What do you have to say about that?

I dont really agree with the law. I think Its a waist of time to try to enforce. If someone is going to do something to the tracks Chances are its not going to happen in the daylight when the "train cops" are right there.

However a law is a law. Would you call the cops if you seen someone ripping off the guy next door?

Well, Bill, how many accidents have occured when the person has no problems. I have heard of a few.Chances are that your reaction times are slow compared to a train coming along a high rate of speed. But then again, it is your choice, but I for one want to be safe.

I would think that you seem to be in the middle of hunters lane....they do this every year and all along ALL yes ALL the row's where there is access to hunting there wil, is going to be, always will be SPORTSMAN.who are ot breaking the law who are not breaking the law anymore than a railfan standing to watch a train. There incursion is as trivial as
yours when you get a little closer for a better view. You can put up no hunting and no tresspassing signs on your own property but i think you feel this is a very limited occurence but it is wide spread. guys will always take the short cuts to the best fishing hunting and nude beach watching........err umm anyways good luck with it all and relax and enjoy the rail show :O)

It's too bad that society has gotten to the point that most expect to be protected from their own stupidity, and, that it is acceptable to profit from tthe results of that stupidity.

The Homeland Stupidity and Paranoia mentality that has taken over the USA will end up with no one having the right to rail fan, hunt, sightsee, or do anything else that we take enjoyment from. Most of it is just hype, and paranoia pandering, to scare the American public into accepting more, and more, regulations and controls.
We are developing the same kind of mentality that Nazi Germany had. Everyone watching everyone, and running straight to the authorities to tattle tale like a bunch of little kids, when they see any violation.

The love of freedom, and my old friend, Common sense, has left the building..

I agree as a railroad employee I have no problems with railfans. I think we have taken this 9-11 way to far as to infringe on the rights of honest americans. I wish Washington would take a chill pill. [:D]
