Who really owns the rights to the New York Central trademark?

Hello:

Based on the MR Express headline article that discusses Atlas's signing with Union Pacific and CSX, it states that the CSX agreement gives Atlas rights to use the New York Central logo etc. American Premiere Underwriters, successor to Penn Central Corp, claims that they own all the NYC intellectural property rights including logos, etc. So who is the rightful owner?

I realize that CSX used the reporting marks NYC during the Conrail merger - however I would be surprised that this gives them the right to demand royalties on "real" NYC models. I am not looking for speculation or argument - does any one know the real answer?
