Doesn't Amtrak has to prove that UP can handle it's freight under a schedule system to prove that it is deliberately choosing it's own freight over Amtrak? Because I have just not seen UP handle a steam passenger special on time nor have I seen any really happy customers of their expedited Frieght service. UPS comes to mind as a client of UP that UP disappoints and can never seem to rise to what UPS expects in a coast to coast time table. It just seems to me that UP only uses a schedule these days as a general guideline.
I read all of the Union Pacific submittal. I see no obvious indication of "muddying".
I think they might have some good points.
But it's up to the STB to consider both Amtrak's and UP's submittal, and to do their job. They may well decide that one side or the other is guilty of "muddying", and incorporate that into their reasoning.
I would recommend that the STB "move it along".

I am sure they are, they finally built longer passing tracks for the MO River Runner between St. Louis and KC. Then they come up with idea of trains needed more axles to set off crossing gates and they have to haul empty cars. One conductor that I know is always pushing for something to be done about UP, he has short freights set off crossing signals OK with not as many axles. And they make Texas Eagle late many times getting to St. Louis. They do not play nice with Amtrak. I rode UP passenger trains more times with my parents and friends pre-Amtrak on trips to CA. My fav today has to be BNSF because they kept the yard going that my Dad worked at for Frisco and they use bridges that Frisco built.
