Read the actual link (and go to the actual docket) -- this is interesting.

Note the absence of an actual published notice in the Federal Register - this is a preliminary document and I'm not sure why it was released in this form.

The "Metrics and Standards" were produced in 2009 and supposed to take effect in 2010.  For reference, you can read them here. (courtesy of APTA)

Actual implementation was then held up (until June 2019!)  by a long, messy suit between AAR (representing freight railroads) and the Government over constitutionality of PRIIA section 207.  Since one part of that section (subsection d, regarding binding arbitration mediated through the STB) was in fact deemed unconstitutional, and the Supreme Court refused to grant certiorari to review that decision, the lawyers got to work to revise the jots and tittles of the proposed rulemaking accordingly.  This is first notice that they have finished that.

I encourage anyone interested to comment during the interval of the NPRM, although it is pretty clear that the Metrics and Standards as amended will take effect.  In my opinion, resolution of this situation is long overdue.

What is the specific 'pending legislation' in Congress concerning standards, and is it still being pursued since the court refused cert?

Notice has come out that FRA issuing rules for on time performance per the PRIIA.  Have to wonder if this is an effort by Choa to sideline the congress from passing peding legislation setting on time performance metrics ?  oriiginal LINK does not work except by putting in personal data.

Looks like it should be a subsection of the 'Lawyers Full Employment Act'.
