I think this is more for they want to run remote control (crewless) trains and the crossings are a problem for the joy stick operator in Jacksonville or whereever.

Looks like 7 collisions at 5 crossings in Scott Co. since 1975. The two injuries being at the same public crossing under two different road #s. 644398Y was private one year than public the next. 4 of the 7 were stalled vehicles which could happen at a quad gated crossing. http://www.wsdot.wa.gov/TA/ProgMgt/Grants/Sight_Eng.pdf the one truck hit at the private crossing almost guaranteed that the FHWA sight requirements were not there and the view of the track was obstructed. A couple of the reports are showing the wrong county and wrong RR but the crossing #s are listed as CSX. http://safetydata.fra.dot.gov/OfficeofSafety/ CSX has 49 private crossings, 7 public at grade crossings, and 11 overpasses/underpasses in Scott Co. according to the FRA data. CSX trains killed 120 people last year and injured close to 200 looks like they would be busy fixing those trouble spots. I wonder if there is 11 under/overpasses or 11 over/underpasses that have been paid for by the DOT?

The CAR had been traveling in an easternly direction at 005 Mph. The railroad was operating on main line track over a public road crossing. The CAR hit the 001 locomotive or rail car o n the crossing. It was clear, during the day and the temperature was 50. There were 0 death(s) and 1 injured in th is incident and a Railroad Injury/Illness Report (form FRA-55a) was also filed. The highway user was moving on the cros sing and was reported to have not stopped. There were 3 occupant(s) in the vehicle. The view of the track was not obs tructed. Hazardous material was not being transported by rail or highway vehicle. The crossing was protected by: Standard flashing lights

The incident occurred in/near ST PAUL city. The rail equipment was reported to have been traveling at 002 Mph with 2 locomotive(s) and 90 cars(s). The CAR had been traveling in a southernly direc tion. The railroad was operating on main line track over a public road crossing. It was clear, at night and the temperature w as 50. There were no reported deaths or injuries. The 45 year old female driver was stalled on the crossing and was re ported to have stopped on crossing. There were 0 occupant(s) in the vehicle. The view of the track was not obstructed . Hazardous material was not being transported by rail or highway vehicle. The crossing was protected by: Crossbucks TRAIN CAME OUT OF TUNNEL AND SAW TAIL LIGHT OF STALLED VEHICLE ON TRACK. PUT TRAIN IN EMERGENCY AND SAW VEHICLE OCCUPAN TS OUT OF VEHICLE FLAGGING TRAIN TO STOP. OCCUPANTS FLED BEFORE SHERIFF ARRIVED.

NEWS FROM UNION PACIFIC R.R.
In a attempt to reduce costs on all its long haul frieght trains. The Union Pacific R.R. in a bold experiment removed all its conductors from those trains and replaced them with talking canary birds. All the canary birds had to do was repeat track warrants back to dispatchers.
The experiment was a failure though. It seems the Canaries stayed awake through out the trip causing annoyance to the train Engineers. "The darn things won't go to sleep" said one Engineer. After numerous complaints from the engineers and there union the birds were removed and conductors returned to service.
Said one Engineer, "It will be nice to get back to those long quiet train runs were the only thing you have to worry about is getting teamed up with is a loud snoring conductor." Several attempts were made to contact the conductors for a reply but it was there nap time.
One Union Pacific official was heard shaking his head "If we can only find a animal that sleeps as long as a Conductor."

NEWFLASH FROM KNN (KY NEWS NETWORK)

The state legislators from KY has announced that they are going to remove all crossing signals and all warning signs from all public crossings immediately. Do to budget shortfalls and IDIOTS trying to beat trains they figure this could save the state millions.

One state legislator was quoted as saying,"After reading the posts on the Trains.com website forums by two people thinking it was the railroads fault for hitting people at crossings, we come to the conclusion that they didn't know their butts from a hole in the ground. But thanks to them bringing us to the attention of FRA reports that people disregard railroad crossing devices to save two minutes, we have decided to take down all crossing devices and warning signs immediately."

The legislators while in meeting said why put up all these crossing warnings if everyone feels that they can just go across the crossing anyway. They feel that the money could be better spent also by paying off the two people that keep starting crap on this website and letting people get back to what this website was intended for. "The joys of railroading."

The governor had no comment but his aides were said to have commented that if people were dumb enough to run a crossing and get hurt then why have the protection. Give the money back to the railroad employees in pay raises, that the state would save.

Hey, pal! What's your hardon for conductors? I don't sleep. I check to make sure that the (MY) train is in compliance (T.O.B., Hazmat, temp restrictions, speed restrictions, permanent speed restrictions, form As, form Bs, setouts, pickups, and placement of the pickups and setouts for tonnage and hazmat, and yes track warrants in TWC and ABS). What do you think happens when we do a pickup? We just tie on and go! Nope! What if more than 1/3 of the tonnage is in the rear 1/4 of my train? Outta compliance! What if I am gonna pick up on the head end, but the pick up has a hazmat within the first 6 cars of the engine consist? Every time i pickup or setout I refigure everything. Even down to axle count and update my wheel accordingly. Will my train fit between the crossing at MP286.5 and 287.2? I know the answer. Do I need to cut the West crossing at Akron if my train is 5500 feet? I could tell you. What if I get a KEY train? What restrictions apply? What's a KEY 1, KEY 5, KEY 20? Do you know the answers to these questions? I do. What is the restrictions for empties in my train? What qualifies a five packer well as a load or empty? What is the speed restriction if my train is over 100 T.O.B. and the ambient temp is 91 degrees? I can answer that. Can you? If you can't then don't bag on my craft!!!! Have you ever spot or pulled cars? Have you ever been on duty for 14:00 hrs, and be in the middle of nowhere? Have you ever tied down a coal load (train) on a 1.4% grade in a snow storm when it is 5 degrees out? I have! Don't talk crap about something that you know very little about. You read about it snug at home while many of us live it while you and your wife/girlfriend are bundled up in bed. My girlfriend is out doing who knows what while I am moving the goods that you use every day! Why don't you tell me what you do for a living. I'm sure that I can sissify it too! After removed the equipment will be resold back to the railroads at the same rediculous prices that where charged the tax-payers and then replaced with 400% more equipment which will be bought and installed WITHOUT A PROFIT.

You take your job to serous. becouse i was a conductor. the haz-mat train you talk about most conductors dont have any idea what they are. they dont know if they are a key train or if the restrictions apply or anything. but they do know how to sleep.

...and possibly buy safety equipment to keep crossings open....So they know safety equipment is missing. The property owners should go back now and demand crossing gates be put in since it's up to the railroad.

DUNGANNON - A group of Dungannon residents was planning a rally this weekend to show opposition to CSX Transportation's planned closure of private rail crossings.

The rally is off.

Possible legal action against CSX has also been put on hold following negotiations between the company and landowners earlier this week.

Dungannon resident Danny Mann and CSX Vice President Robert Shinn both voiced optimism Thursday as a result of a meeting between the parties involved in a nearly monthlong debate over company and landowners' rights.

"I certainly feel a little more positive about things after we sat down with Mr. Shinn on Tuesday,'' said Mann. "Although he acknowledged that the deed language (in our deed) states the railroad is responsible for the crossing, we are still looking for something in writing.''

Shinn viewed the meeting and the entire trip to Scott County earlier this week as "positive" and said he believes a resolution that will please all parties involved is soon to follow.

"Going out there and seeing the crossings and talking face to face with individuals and hearing their concerns was educational and positive,'' said Shinn.

"I think we did largely resolve the outstanding concerns of the residents. We are not going to remove, permanently, the crossings that people are using for their residences and farms that are in active use as a result of the upcoming maintenance," Shinn added. "If there are any redundant or unnecessary crossings - for example if there is a farmer has two crossings who could just use one, we think that is something that could be addressed in a reasonable and cooperative manner.''

CSX decided to address private rail crossing issues in Scott County and other localities as part of a 10-day "maintenance blitz" that is scheduled for the end of this month.

Previous stipulations issued by the company stated land owners would have to pay a $150 annual license fee, provide liability insurance, and possibly buy safety equipment to keep crossings open, but Shinn said CSX has backed away from those demands.

Government officials, including U.S. Rep. Rick Boucher, U.S. Sen. George Allen and Delegate Terry Kilgore, have also become involved in the process, asking the company to reconsider its stringent requirements.

"We intend to work with property owners on an individual basis. In the meantime, we would advise property owners to do nothing unless contacted by CSX,'' said Shinn.

"If they would like to proactively obtain rights to the crossing, we would sit down and discuss that. But we are also looking at deed language and the wagonway statute in some situations, which may help some property owners,'' he said.

The wagonway statute was originally developed and passed into Virginia law in the 1800s to provide landowners access to their land despite having a rail crossing that traverses their property.

The statute guarantees an owner property access if their farm or dwelling is on either side of a crossing, according to Scott County Attorney Dean Foster.

"In a situation where a deed stipulates railroad responsibility, we will try to issue a letter to them following this maintenance blitz to signify their crossing rights,'' Shinn said.

"This is an issue that may have conversations between (CSX) and the landowners taking place in a couple of weeks or a couple of months," he added. "We are still unsure how many people we will have to contact at this point. We are still researching this issue, and we will hopefully come to a resolution that is suitable for both parties.''

Mann noted that a previously advertised rally against CSX scheduled for Saturday has been canceled since the company has made "a conscious effort'' to try and settle some issues.

He also told his legal counsel, Pennington Gap attorney Ronnie Montgomery, to not follow through with litigation that would have an injunction filed against CSX in Scott County Circuit Court.

"We are in a wait-and-see mode right now,'' said Mann.

§ 56-16. Wagonways to be constructed across roads, railroads, canals,
and other works; enforcement.

For the purpose of this section, "wagonway" means a vehicular
crossing adequate to permit the passage of machinery and vehicles used
for agricultural or forestal purposes, including but not limited to the
transportation of agricultural and forestal products to markets. Every
public service corporation whose road, railroad, canal, or works passes
through the lands of any person in this Commonwealth shall provide and
maintain proper and suitable wagonways across such road, railroad,
canal, or other works, from one part of such land to the other, and
shall keep such wagonways in good repair. Such wagonways shall be
constructed and maintained on the request of the landowner, in writing,
by certified mail, made to the registered agent for the corporation
owning such road, railroad, canal, or other works at that point, and
shall designate the points at which the wagonways are desired. If the
company fails or refuses for ninety days after such request to
construct and maintain wagonways of a convenient and proper character
at the places designated, then the owner may apply to the circuit court
of the county or city wherein such land is located for the appointment
of three disinterested persons whose lands do not abut on such road,
railroad, canal, or other works, who shall constitute a board of
commissioners whose duty it shall be to go upon the land and determine
whether the requested wagonways should be constructed and maintained.

Any delay in construction or maintenance caused by inclement weather,
war, strikes, acts of God, national emergencies, or failure of any
local, state, or federal government agencies to grant permits shall
extend the aforesaid period. The decision of such board shall be in
writing and, if favorable to the landowner, shall set forth the points
at which the wagonways should be constructed and maintained, giving
also a description of what should be done by the company to make and
maintain a suitable and convenient wagonway. The decision of the board
of commissioners shall be returned to, and filed in, the clerk's
office of such court, and when called up at the next or any succeeding
term of such court, it shall be confirmed, unless good cause is shown
against it by the company. Either party shall have the right of appeal
to the Supreme Court from the judgment of the court. If the company
fails, within a reasonable time fixed by the court at the time of the
confirmation of a report favorable to the landowner, to make and
maintain the wagonways therein referred to, it shall pay the landowner
fifty dollars for each day of such failure, which may be recovered on
motion by the landowner against the company, in the circuit court of
the county or city wherein such land is located having jurisdiction to
try the same. The commissioners shall each receive for their services
the sum of fifty dollars per day, to be taxed as a part of the costs of
the proceeding.

Once the right to such wagonway has been established, should the
railroad change the grade of any portion of the tracks across which
such wagonway passes, it shall be the duty of the railroad to make
whatever reasonable modifications of the wagonway are necessary within
the railroad right-of-way to permit the passage of the aforesaid
machinery and vehicles.

So let me break this down so even you can understand it. The private crossing in which they are refering to never needed any protection it was a means of letting a farmer get in his fields there is no law in which a railroad has to put up safty devices on private crossings. What the people are trying to do is keep the land from being land locked. if the railroad closes a crossing then they never haft to reopen it. this is what the people are trying to keep from happening. the blitz they are talking about is probly a T&S gang in which they will rip out all crossing and resurface the tracks, then put crossing back in now what the railroad dont want is to put in crossings at every field when there is other ways in there if the public wants it that way they can pay to have it. and i will tell you this oncee they can justify that a man can get to his fields from a differant crossing then one of the other crossings is gone.

That would require mossouri to do at least three things we know he is incapable of.
1: Read, as in read the entire law, not just the part that seems to uphold his screwed up view of the real world.
2: Cut and paste the entire notation, not just the parts that upholds his screwed view of the real world.
3: Make sense, instead of his screwd up version
of whatever he read from the real world.
Oh and I forgot #4
4: Live in the real world in the first place.

They took down all the "DO NOT STOP ON TRACKS" signs from the rairoad crossing light posts

and put up a new sign

a Capitol "P" enclosed around a Green cirlce, and underneith is says: 2 Minutes Maximim.

so, for missouri only...

the new logo hopefolly all railways will adopt..
