MC is correct. The ICC used to be the primary agency in approving or denying railroad mergers and acquisitions, but was replaced by the STB in 1995 or 1996 (I do not know the exact effective date) under the Interstate Commerce Commission Termination Act of 1995 (Reference: http://www.STB.DOT.gov/stb/about/overview.html).

After all remember the failed Santa Fe -Southern Pacific Merger. And the Wisconsin Centeral - Canadian National merger. Although the WC was a regional and the CN is international so some other international trade agencies where invovled also.

The ICC no longer exists....It is now the STB.

Yeah I know convicted felons get elected to congress. But Delay's PAC gives out money to other reps who are fighting to stay in office. Now if you do not vote the way Mr Delay says forget about getting money and he does it for both the House and the Senate. The law on Texas is very clear NO MONEY from a PAC can be from a corparaqtion can be used for election campaigns or to run issue ads. His PAC has done both.

He is also the one who pushed so hard to impeach Clinton for reciveing a you know what in the Oval Office. Bush flat out lied to US to go to war and it so far has cost over 1800 dead both military and civilans. Now who has done something worse infedilaty of lying to take over a country.[soapbox][soapbox]. I am sorry for ranting so much but Delay and his buddies are going to put this country in such a hole we will NEVER RECOVER From it. We have no credabilty in the UN we are considered a bully by every other nation. At least under Clinton North Korea stopped their devolpment on Nukes. Now they have them and have the missles if they wanted they could take out Tokyo and maybe LA.

Don't forget, his constituents elect him. If he's doing all right by them, why should they get rid of him? What's more, he's a representative, not a senator - all he has to please to stay in office is a small geographic portion of Texas. The rest of the country can visit that small community in Michigan as far as he probably cares.

Convicted felons have been re-elected to national office...

Ouch - politics. Supposed to stay away from that...

I think the Department of Justice also has a say on anti-trust issues, but they take a back seat to the STB.

Jim

During the merger review of ESPEE and YOUPEE, the DOJ advised that this merger should NOT go through...

The STB is a stacked deck, GW BUSH is for extortion of monies that are whanting the merger!

Now this is humor! BUSH was not there yet!

STB - http://www.STB.DOT.gov/
In most cases, the corporate acquisition and merger would also have to be approved by the Securities & Exchange Commission as well, but their requirements are much less strict than the STB's standards for mergers.

Class I Railroad Merger Questions
Posted by Anonymous on Sunday, April 17, 2005 12:45 PM
Just for conversation, What Federal Department or Agency is responsible for approving Class I Railroad mergers? What is the process? Surface Transportation Board? Department of Transportation? Federal Trade Commission?

Best regards,
Frank Swafford
