CSX and New York State Agree to $1.5M Settlement

The link below leads to an article in the Rochester, NY Democrat & Chronicle newspaper about the year long "discussions" between the NY Attorney General (next NY governor?) and CSX over grade crossing safety.
Hopefully, good will come of all this, no matter what your opinion is of the overall problem.

aah, this article explains it in more detail than the News Wire item. To be honest this is a scary scenario. Could this happen to anyone? I consider myself to be an observant driver/railfan.
I don't know what type of grade crossing was the site of this fatal collision (remote highway? small-town main street?). If I do see a crossing signal with lights and gates at a crossing I normally "assume" it would work properly if a train were nearby. Dangerous assumption? Foolish assumption?
Stopping at each crossing (like some commercial vehicles are required to do) would likely cause a rear-end collision on the road though.
