Part of the problem with the legal system today - he'll get a check for $250,000 and fade into the woodwork.
If he knew that he might lose, and would have to pay the ensuing legal bills, he might not be so eager...
That's not to say he didn't suffer an injury, and he should certainly be compensated for the costs accompanying same.
