All it should take (not that it will) would be a federal law stating that if you do not have permission or an overriding reason to be there (like a policeman investigating something or conservation officer tracking animals, etc) you do not have the right to expect the owner to look out for your welfare. In otherwords, trespassers beware. That would (should?) at least slow down the wrongful injury lawsuits and make property owners less paranoid.

She's lucky.
Spent this weekend doing a detail at a local dirt track. Right next to the track is a clay quarry. It's four wheeler heaven. Two years ago, a sixteen year old flipped his four wheeler on the property, and broke his arm. The parents sued the quarry owners. Out of the thirteen arrests we made this weekend, 11 of them were for trespassing in the quarry, which is now heavily posted with "No Trespassing" signs. One of the arrests has the additional charge of resisting arrest, when we had to chase his four wheeler for about a mile before six officers boxed him in and caught him.

It's a shame that people who can use property responsibly don't have a way of getting permission to do so. Owners of industrial property are deathly afraid of law suits like this one. They tend to close the property to everyone- in a railroad's case, to people like you or I, someone who has a good idea of what's safe and what's stupid. In the case of the quarry, the "good" four wheelers- those who were out sightseeing- got nailed just as hard as the idiots looking for a place to "open her up".

There's got to be a middle, more moderate road in there somewhere, but I don't know what it is. I'll keep investing in telephoto lenses to take my pictures...

Don't know. The fact that she survived, should have clued her into a life flash not a brain fart-(sueing NS for her stupidity). Just goes to show you the diversity of people's stupidity; morons come a long way.

Umm, perhaps this is a stupid question, but how the HELL does anyone suffer "minor injuries" after getting hit by a train??? especially on a mainline where freight is moving along at about 60. She must be a BIG gal!!!

I JUST READ IN TRAINS NEWS WIRE WHERE A WOMAN IN PENNSYLVANIA IS SUEING NS AFTER BEING STRUCK BY A TRAIN. APPARENTLY SHE WAS AROUND THE NS MAIN LINE AND SUFFERED MINOR INJURIES WHEN SHE WAS HIT. I DON'T KNOW ABOUT PENNSYLVANIA, BUT IN NEW YORK IT IS ILLEGAL TO BE ON THE TRACKS. GEE A LITTLE OF THAT THING CALLED COMMON SENSE MIGHT HELP. HOPE NS WIN THAT ONE!! THEY SHOULD BE SUEING HER.[
