The Rules state the marker only needs to be lit from 1 hour before dusk to 1 hour after dawn, and when visibility is less then 1/4 mile.

Now adays, EOTs are equipped with photocells, that light the marker at the appropriate times.

I watched a long BNSF grain tarin go through our town last Saturday. It was snowing lightly and I was enjoying the sight and sound of cars on jointed rail. After the last car passed, I noticed that FRED was not lit or flasing. Is this legalm or was it some kind of malfuncion. It was morning (about 11 am.)
