VIA will win the lawsuite on the basis of the acts that set up VIA in the first place. The court may give the CP the option of providing the passenger service themselves!

The CPR, in another move to make things difficult for the E&N Railway and VIA Rail has decided not to allow Herzog to use the Victoria Shops. As a result, VIA Rail Canada has filed a lawsuit against the Canadian Pacific Railway seeking a court injuction to allow Herzog to use the Roundhouse and shops in Victoria. Until a decision can be made, the Budd RDC's will be deadheaded to Victoria from the Wellcox yard in Nanaimo, a distance of 70 miles!!
The CPR can take a flying leap as far as I'm concerned. I'm so sick and tired of them pulling this crap just because they don't want the E&N to succeed where they couldn't be bothered to.
