I agree with the interesting part for sure.     My bet would be some kind of reduced settlement might be in the works since the appeal was granted.  Both parties would be better off to decide on a resonable amount,   maybe $5,000,000.00 or so and go on with their business.

When the verdict was announced about a year or so ago, I thought to myself.  

This is not over!

 Another clipping to put in my "follow the legal beagles in trainland" file. If litigation in "trainland" continues I might have to go to microfiche to save space for all the trial transcripts. Wink [;)]

 I am glad that I am not the only one that thought a sequel would take place.

We probably won't know anything for months about any negotiations until they are done, if that is the way this will end. 

I can't image paying lawyers to start this up again unless some legal team takes the case on a percentage.  This case must have cost Millions on both sides. 

  Maybe Neil Young will sell out to Mike and the whole thing would be dropped.

The court also ruled that testimony from MTH's expert witness was inadmissible.

Mike would be talking settlement now if he knows what's good for him.

I just bought the Polar Express and this is the first non HO scale item I have purcahsed in years.  I was getting a bit tired of planning the new layout and thought about taking a break for a few months when I set up the Polar Express around the tree last night.  We had friends over and we all enjoyed setting it up and watching it run.  My wonderful wife, who is a little tired of hearing me talk about what I want to do with the layout, sat for hours and watched it run in a circle.  A little later she admitted to me that she really likes trains and is glad that we added the polar express to our Christmas celebration.  Our 18-month old nephew watched the train for hours.  When we stopped the train to eat dinner he ran up to it and said "GO!"  We told him it was time to eat and that we would run it later.  He then reached for the throttle knowing that was how we made it "Go!"  We had a great time and enjoyed a little bit of the Christmas magic from our parents generation.  

All of the legal fighting aside, is this not the magic we all want?  Let stop the destructive fighting and  find a reasonable solution and move on down the tracks.  We all want Lionel and MTH to succeed.  Instead of fighting, why not cooperate?  If not, we may have a Christmas where there are no trains around the tree.  A few individuals may feel a sense of moral justifiaction but the rest of us face a great loss.  Lionel made a mistake.  Lets resolve the matter and move on in the best interest of our hobby.
