I would look for a gap in the existence of that mark. The entity to which that trademark originally belonged has been assimilated and no longer exists. One would have to read the contract between the roads to see what the disposition on marks was. <br /> <br />This point will be the subject of much wrangling, if it hasn't been in prior cases already.
