It needs a ballast resistor to feed it from the voltage source to absorb excess voltage when the source voltage rises above 36 volts (and the output voltage stays clamped at 36 volts). If this was intended as a protection device for overvoltage spikes to the layout, it is not effective for transients and 36 volts is too high anyway.
