I just have a question about this matter. How is it that MTH can make copies of Lionel tinplate engines and equipment along with Ives, and they don't get sued by Lionel?
They make a lot of money off tinplate and they're the ones that should be sued.
What's wrong with the judge and jury? Why can't they see this evidence? I mean they are copied right down to the bone. look at their tinplate 2005 catolog. i think they should stop producing the stuff. just my .02 cents worth.[:(!]

Lionel let the patents expire. MTH didn't and won't. I suspect Lionel won't anymore either.

In my lionel book, Lionel made a deal with MTH. It was fair, and let lionel continue with it's oun stuff.

It gets thicker: 3 of the trains in the trial were MTH reproductions of prewar Lionel: 392E, baby blue commet, and hiawatha. The judge ruled these designs to be owned by MTH. Expired patent or non expired patent, we live under some downright silly laws. In the laws of ethics, a thief was robbed.
