As requested by several peoplem I repested My post explaining what the lawsuit is all about. Obviously somebody did not like what I said. Possibly one of the litigants. Can't
imagine which one. Somebody with more lobbying influence than I have. I hope the loser really loses BIG TIME. Then they will not advertise in Magazines any ,ore--EH What?????

Topics of this nature will not stop just because a few people don't like it. They need to be allowed to run their course. A little fighting between the members is no big deal, we suffered greater challenges last spring, and survived with virtually no intervention. Continual deletion of contraversial subjects is a total disservice to the members. It saddens me deeply that the moderator has chosen to listen to the whinings of a few.

Let's all go to Disney World where everything is always happy. That seems to be the message, and the OGR way. Kalmbach is better than that, and the members here deserve better too.

Bergie, this is not personal, nor is it intended to be judgemental or challenging of your position. I beg you, please stop deleting the topics here on CTT. This situation is not the same as on the other forums. There is a special dynamic at work here. This is a battle between rival gangs, or political factions within the hobby.

Certain individuals who are not the regular members on this forum, come here to cause trouble. They seem to have an agenda, and enjoy picking fights to further their cause. It is their hope to cause the deletion of topics, of which, they do not approve.

I respectfully request that in the future, especially when it comes to CTT, that you only lock topics that you find problematic. This will perserve the record, end discussion (at least temporarily), and not leave everyone wondering what happened.

I got to read your post earlier today Walt. Thanks for the info.

I don't think its you Walt that keeps getting the post yanked. I think its the comments that come after. Your post, in my opinion, was respectful and informative. I did not get the impression you in any way were one sided. At least now with Bigboy's post and yours, I know who QSI is. Thanks guys.

Just for interest, in early October, MTH's lawsuit charging patent infringement against QSI and Broadway Limited was dismissed based upon lack of jurisdiction in Maryland Federal District Court, and also for lack of cause, since BLI and QSI ceased and desisted in sale of the product in question.

Beside deleting a whole subject, one can also delete single posts in a subject to keep it informative and to the subject.
I know most of the members of this forum for over half a year now, and I can't emagine anyone of them making such troublesome remarks that the item should be deleted.
There where hard discussions going on about the Lionel vs UP and the Lionel vs MTH trails too. None of them had been deleted.
There is one big difference in this QSI thing. In the UP/Lionel thing, no one directly involved in the UP scene, nor someone of Lionel spoke openly and in name of his business about the trail. Also in the Lionel/MTH trail, no-one directly involved came up here to to explain his point of view.
Now with this trail, one of the involved explains why he is trying to lawsuit MTH.. This is not only a personal message, but also one in name of his business.. I guess that Bergie deleted this one because it starts to get too close to the frontline and besides that, it can be seen as an inderect advertisement.
I know that temptation is huge when you are involved and know what's going on, but I must agree with Bergie in this; this is a hobby-forum, and it should stay that way.
Before we know we have MTH men, Lionel men and whatever else men fighting with eachother on our forums to win our attention, and then this forum dies..

using this subject as an advertizing vehicle. As a very small fish in a very large pond,I
merely stated a factual description of My knowledge of events leading up to the actual
filing of the Lawsuit. I have purchased and used products from both Companies,and have no direct affiliation with either one,other than that of a customer. I will stand to niether gain or lose financially or any other way,regardless of the final findings in the case. I merely stated factually one or more incidents in which I have direct personal knowledge of those events. Therefore if My posts were the cause of deleting a thread
it and only be attributed to censoring and suppression of facts. This is entirely at the discretion(Or rather indiscretion) of CTT and the forum Moderators.
I am merely an Old American citizen who has for seventy or more Years loved the hobby
and am deeply distressed that it has come to this--In America(and Korea and China I guess)

Again, it was behavior related, not content related.

I can't imagine Bergie was too pleased to come to work this morning, and find the topic with which he tried to end the original topic, had been over run, and was larger than the original topic itself. Plus the behavior that was trying to be stopped, hadn't.

Does someone different moderate the model rr fourm. The reason I ask is the hot and heated comments between members and Andy E about the new MTH entry never got deleted.
This thread hasn;t gotten anywhere close to that in my opinion.
It does seem to make a difference when the name of a certain board moderator is mentioned, and that came up just before the deletion in question.
Again just my opinion and trying to guess why it happened is going to bring about more comments than if our moderator just came out and said why.

With all these legal fees and whatnot, I wonder how much all this electronic stuff is really costing us. Tack on the poor reliability to boot. Air whistles and E units never looked so good.

I just think that certain individuals come here to cause trouble. Tony Lash, on the other hand is close to MTH and has much to say on this issue and I welcome him to this forum.

Mr. Donaldson, yes it is allot better over here. My only concern is the two threads I have commeted on got deleted, which makes me think it must be something I said.
I went over to the other fourm today for the 1st time in along time and I see right at the top the comment on deletions. The topics over there are very bland now compared to what they used to be.
I didn;t see anything over there I even cared to read. The moderator must be really deleting like crazy , or did I just pick a dry day.

From what I hear, the events of the last few months are just prelude to additional legal ramifications and turmoil in the industry. There are certain heavy hitters that have not yet been heard from. My guess is that the magazines,who depend on the health of the industry, are increasingly and understandably concerned that the constant negative waves and arguments are detrimental to the hobby and to business as usual. They are probably right, but it is frustrating to have discussion stifled. Until the heavy hitters weigh in and the appeal decision is made, I'm going to lay low unless something really interesting comes my way. One little tidbit before retiring: In a decision rendered June 27, 2003 in Western Virginia Federal District Court, US Magistrate Judge BW Crigler found that plaintiff MTH had failed to pursue discovery diligently or comply with that court's order to identify its expert witnesses, and recommended a dismissal of MTH's suit charging theft of trade secrets by Broadway Limited, providing MTH pay defendant's attorney's fees and costs. I hadn't heard about that one until the Maryland District Court told MTH to take a hike with a similar lawsuit when it dismissed MTH's latest lawsuit on October 6th, 2004. Can you say "reversal on appeal in Michigan?" Could be. :)
