Older units are grandfathered and are still going to be perfectly viable for quite some time. As you may have seen here or in trains mag, UP and presumably BNSF and other's are experimenting with retrofits to meet new standards for rebuilding units to meet the new standards, also both builders and aftermarket suppliers have or are in the process of designing retrofit kits to meet the new standards. The SD40 still has life in it! Also there are waivers available to smaller lines which lack the resources of the big boys to upgrade at a whim.</p>
