But you have to admit it's better than 'the train, it appears, was unsuccessful in taking evasive action to safely avoid collision'...

or

Well once again, train 1, truck 0.  I do not think that the railroad wil l have to pay for the damaged cargo because the truck go stuck on the tracks. Drivers fault.
