I don't know the answer for certain. There is no question about the fact that the runaway was ultimately the fault of the MM&A. But if the oil never burned, there might have been no damage whatsoever to anything other than MM&A property. And if the oil never burned, there may have been no loss of life. </span></p> <p><span style="font-family:verdana,geneva;font-size:small;">I do not know what was expected regarding the oil flammability, but if the regulations expected no fire, then I would think that the liability will spread to the oil producer who shipped the oil. I don't see any reason why the liabillity has to land on one specific element of the disaster cause. And I would say that the fire was by far the biggest element of the disaster.</span></p> <p><span style="font-family:verdana,geneva;font-size:small;">In my opinion, this FRA probing of how the oil might have affected the disaster contemplates spreading the liabilty to more sources to provide greater funding to compensate the damage. </span></p>
