Don't recognize the train. I can't quite read the plate, but it resembles Virginia.
Judging by the way the wheels are slightly cocked, I'd have to say that the driver was on his way around the gates.
The configuration of the locomotive and tender is interesting - looks like a 4-2-0, sort of, with an articulated truck between the locomotive and the tender. the grille on the tender suggests that there is an engine in the tender, and the location of the driver suggests that it's just along for the ride...

The engine is a pretty standard 4-2-4 park engine, with drive shafts to the front and rear trucks. The trucks look like EMD Blombergs, though they aren't very visible in the photo.

I did a little research after posting and found other pictures of it, so I'm straight on that now. It's supposed to be a replica of a full sized engine (I don't remember where or what, no matter).
The lighting, shadows, and limited nature of the picture (with regard to the locomotive) were a little confusing. There's a video of it running on YouTube.

You can see the train and the park, including a shot of Houston's Metro Light Rail service, several nice shots of the park, Rice University is just across the street.
The train ride has been there forever, since I was a little kid, it was my first train ride, used to have a "diesel" locomotive in SP Black Widow paint.
The SP Steam Locomotive at Minute Maid Park used to be on display at the park train's depot/parking lot.
This locomotive is somewhat a copy of the one that is part of the Seal of The City of Houston.

I have absolutely no sympathy for the stupid car driver, but I hope the train driver and any children riding it were not hurt.

My bet is they parked there, thinking either the train wasn't running or they would be out of there. Or - while texting, didn't see the rr tracks!

Yeah, I don't know which is worse: A car stopped on the tracks, or the train being operated in a fashion that wouldn't allow it to be able to STOP for something stopped on the tracks (especially on a crossing like that). In real railroad life, if you were supposed to be operating restricted speed and broadsided a car parked on a crossing - the crew would be at fault.
Bad situation all around. I think the operations there need tweaked.
