Many of the Pole Responses voting "NO" seem to have never model Union Pacific. Most model railroaders do not have the full understanding of what Union Pacific is desiring from the manufactures of model railroad items. Sometimes, you have to ask for some huge bucks to get a wake up call when another manufacture is stealing your logo as UP did with the 40 million dollar law suit.

The model railroaders who do model after UP seem to continued collecting with little effect. As well, Union Pacifc has had a long history of deverse locomotives like the
4-8-8-4 Big Boy, Challenger, DD-40 and also Veranda Diesel with Tender that would not be prototypically correct with other road names on them. Each really nice to have in any collection just as the Southern Pacific Cab Forward that no other railroad operated and currently fallen to the UP line.

At first, I was ready to BOYCOTT Union Pacific . Why would some large business like Union Pacific care about a silly license agreement on anything with "UP" register trade mark on it especially when it would be great advertising and good for business. Why would UP care about Athearn or Lionel? However, licensing is important. People need to have permission to use trade names which they do not own. Such as those like SEARS, Budwieser, Coke Cola, Ford, John Deere or Boston Red Sox... These names are legal trade marks that require authorization to use. ATHEARN and LIONEL did not ask for permission nor have it before using them ....Also,. Union Pacific was not after BIG BUCKS from manufactures using their name, They only wanted manufacutures to have an agreement of authorization to use their name, logos and fallen Flags.

If Union Pacific was to get out of hand with this demanding huge royalties, I would BOYCOTT them as I support our fellow model railroaders. The 40 million does not seem to be sought after but more of an attention getter which worked. As well, they have come to an agreement with Athearn "Horizon Hobby" and likely soon have agreements worked out with LIONEL an other manufactures of goods that have the trade marks of Union Pacific and those names which UP holds ownership with. What is important to keep in mind is if you owned a large business that had someone making money off your trade name which was not connected with your operation or liabilities, then they are stealing from you where you deserve a royalty. That was not being offered to Union Pacific. Additionally, UP wants manufactures of model railroad to make only items in which they use. They do not want to see a locomotive such as the GG-1 with UP heralds on it if they never owned one in their fleet. With these agreements, there is no need to BOYCOT Union PACIFIC...... Take the time to read Union Pacific Web Site and support the WORLD GREATEST HOBBY: "MODEL RAILROADING" . http://www.uprr.com/newsinfo/modelrail.shtml However, what I believe Union Pacific should do with any royalties earned through model railroading is to use towards education, museums and support of model railroaders.
