Read the article, and sent a comment to the news comment block, but in a nutshell, CSX needs to take a deep breath and chill out. No-one's hurting their trade by applying an obsolete logo from a lon-gone railroad to a current locomotive. I mean, really.
5 will get you 10 that it shows up with big black stripes through the C&O logo in a week. It may be possible that the C&O is still a legal entity under the CSX corporate banner, just as the Soo Line still exists under CP as one example.
Certainly creative. This is an industry that's very aware of its history.
There is also the legal requirement that a trademark must be protected if you wish to keep control over it.
I saw it go by the Horseshoe Curve webcam a day or two ago. I don't know how long it will survive but it certainly is neat to see.
Just for grins ... has anyone looked up close to see if the (R) trademark is present next to each logo? That, with even a nominal payment or permission from CSX, would satisfy the requirement for 'infringement', and it could be argued that CSX is gaining from the publicity in ways that would not tend to confuse its trade customers...
