So let me see if I get this straight now, as the gray area seems to be do I have a "right to take photos, or do the railroaders have a "right" to tell me not to. So If I am public property, usually there will be no problem since only a small minority of railroaders think that it is a problem to take pictures of there train, I am sure most would love to be driving the train that wins some photo contest. If someone, say a railroad worker, tells me I can't take pictures of the train from the public road that parallels the train yard. What should I do? Does he have the right to tell me not to? Should I phone the yardmaster, or someone and just make sure they don't have a beef then go take some more pictures. What about the police telling me, since they don't always represent the railroad’s want on the matter? Of course you should always be polite. <br /> <br />I am not trying to start an argument here, I was just under the impression from what I had read about the law, that you had the ability to take a picture of trains from public property, assuming the train tacks don't have any signs saying you can't. You couldn't sell a picture of a railroad worker without his approval, like a celebrity, assuming he was recognizable in the picture. It is not a matter of rights to take the picture, but who has the right to stop you. Feel free to correct me if I am wrong, so I don't make any mistakes in the future. <br />
