Is there any difference to the freight railroads if online passenger trains are being operated by Amtrak or by some other entity? I find it interesting that some of the people who are the most vociferous in their opposition to Open Access find no fault with Amtrak having that same privilege. Ideally, the implementation of Open Access policies would be the easiest solution to allowing private passenger rail services to thrive. Outside of that obvious solution, there will always be a gray area regarding the rights and privileges ascribed to Amtrak and whether those access rights are transferable to some degree.
