Miller is already convicted for his crime I think. I think the CSX attorneys thought the two letters saying no were enough to avoid the current verdict. Here in Germany it is checked if you have done everything reasonable to avoid an accident even when the opponent took your right of way. If the court comes to the conclusion you haven't you have to carry part of the costs. That might have happened in court with CSX. Regards, Volker
