Everybody seems to opposed to fencing the right-of-way for safety reasons since the fences would prevent them from doing something stupid on the way to the beach.

But they're Californians!  Everyone out there knows that it's been the law for decades now that pedestrians have an absolute right-of-way in traffic!

 

More specifically, they're Del Martians... Quite a bit of the beach side r-o-w in San Clemente is fenced.

The "absolute" pedestrian right-of-way until recently was limited to intersections without traffic lights and designated cross walks. In many area, jay-walking was a good way to get a traffic citation.
