I haven't seen this pop up on the Newswire or in the discussion forums. It seems that CSX carelessness caused the destruction of five freshly rebuilt locomotives being shipped to the port of Wilmington for onward dispatch to Boke Project in Guinea.
CSX pressed for summary dismissal but the judge sided with the insurance company Lloyd's of London.
The derailment in a washout also ended the careers of the traincrew due to injuries.

All I can say, the EHH version of CSX (which began in March 2017) was not the safety conscious CSX I retired from in 2016.

This case does have merit. If your operating strategy won't allow for safety even during a hurricane hitting your system then you have major problems with safety. Crap like this is why PSR is hated by the workers at the railroads themselves and their customers.

From experience - different railroad divisions - in many cases are different railroads separated by a common rule book.
On CSX, at least in the pre-EHH days, the Division Manager's ran their territories in multiple unique manners. The management style ran the gamut of the legally acceptable - and maybe in some cases legally shady.
During my final 26 years I worked as a part of the Atlanta Division, Baltimore Division, Jacksonville Division, Mobile Division and Tampa Division. Each was operated in its own way, with differing expectations of performance in similar situations.
