Railroad Retirement Benefits for same sex couples?

Seeing that civil unions and same sex marriage is ruled to be a state issue how does the Railroad Retirement Board and the Rail Unions like UTU handle claims by their spouses? Does it depend on the railroad?I know that if you were a public communter conducter for Metro North you probaly would get what you are entitled to but if you are working for a private company or in a state thatr does not reconises same sex marrige then what? Is there a federal rule on this?

Wow, you have so not been paying attention.  That same sex marriage is allowed everywhere in the United States has been the law of the land since June 26, 2015 as a result of the Supreme Court of the United States civil rights case of Obergefell v. Hodges.  So, yes, Railroad Retirement benefits are uniform for ALL married couples in the United States.
