As I understand it, the engineer knew that his vision was varying from day to day, and could therefore recognize when it was at its poorest state. Also, as I understand it, the engineer could not disinguish red from green at times. </span></p> <p><span style="font-family:verdana,geneva;font-size:small;">What I wonder is whether the engineer routinely passed signals while <span style="text-decoration:underline;">realizing</span> that he could not tell their aspect. </span></p> <p><span style="font-family:verdana,geneva;font-size:small;">That would be much different than failing to interpret the aspect of signals being passed, but not being aware of the failure. </span></p> <p><span style="font-family:verdana,geneva;font-size:small;">The latter would be an accident. The former would be a crime. </span></p>
