Secondly, since the USACE is a government agency, they get more of the eco-interference than a private entity would. </p><p>I would expect that the DM&E project, being one that is to be funded partly by federal funds and needing eminent domain for brand new ROW, will also experience a greater than average share of eco-litigation than most railroads would experience, but not to the level experienced by the USACE.</p>
